55 AN ACT
66 relating to the provision of financial assistance to survivors of
77 certain members of the Texas military forces.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 615.003, Government Code, is amended to
1010 read as follows:
1111 Sec. 615.003. APPLICABILITY. This chapter applies only to
1212 eligible survivors of the following individuals:
1313 (1) an individual:
1414 (A) elected, appointed, or employed as a peace
1515 officer by the state or a political subdivision of the state under
1616 Article 2.12, Code of Criminal Procedure, or other law; or
1717 (B) employed as a peace officer by a private
1818 institution of higher education, including a private junior
1919 college, that is located in this state under Section 51.212,
2020 Education Code;
2121 (2) a paid probation officer appointed by the director
2222 of a community supervision and corrections department who has the
2323 duties set out in Section 76.002 and the qualifications set out in
2424 Section 76.005, or who was appointed in accordance with prior law;
2525 (3) a parole officer employed by the Texas Department
2626 of Criminal Justice who has the duties set out in Section 508.001
2727 and the qualifications set out in Section 508.113 or in prior law;
2828 (4) a paid jailer;
2929 (5) a member of an organized police reserve or
3030 auxiliary unit who regularly assists peace officers in enforcing
3131 criminal laws;
3232 (6) a member of the class of employees of the
3333 correctional institutions division formally designated as
3434 custodial personnel under Section 615.006 by the Texas Board of
3535 Criminal Justice or its predecessor in function;
3636 (7) a jailer or guard of a county jail who is appointed
3737 by the sheriff and who:
3838 (A) performs a security, custodial, or
3939 supervisory function over the admittance, confinement, or
4040 discharge of prisoners; and
4141 (B) is certified by the Texas Commission on Law
4242 Enforcement;
4343 (8) a juvenile correctional employee of the Texas
4444 Juvenile Justice Department;
4545 (9) an employee of the Health and Human Services
4646 Commission [Department of Aging and Disability Services or
4747 Department of State Health Services] who:
4848 (A) works at the commission's [department's]
4949 maximum security unit; or
5050 (B) performs on-site services for the Texas
5151 Department of Criminal Justice;
5252 (10) an individual who is employed by the state or a
5353 political or legal subdivision and is subject to certification by
5454 the Texas Commission on Fire Protection;
5555 (11) an individual employed by the state or a
5656 political or legal subdivision whose principal duties are aircraft
5757 crash and rescue fire fighting;
5858 (12) a member of an organized volunteer fire-fighting
5959 unit that:
6060 (A) renders fire-fighting services without
6161 remuneration; and
6262 (B) conducts a minimum of two drills each month,
6363 each two hours long;
6464 (13) an individual who:
6565 (A) performs emergency medical services or
6666 operates an ambulance;
6767 (B) is employed by a political subdivision of the
6868 state or is an emergency medical services volunteer as defined by
6969 Section 773.003, Health and Safety Code; and
7070 (C) is qualified as an emergency care attendant
7171 or at a higher level of training under Section 773.046, 773.047,
7272 773.048, 773.049, or 773.0495, Health and Safety Code;
7373 (14) an individual who is employed or formally
7474 designated as a chaplain for:
7575 (A) an organized volunteer fire-fighting unit or
7676 other fire department of this state or of a political subdivision of
7777 this state;
7878 (B) a law enforcement agency of this state or of a
7979 political subdivision of this state; or
8080 (C) the Texas Department of Criminal Justice;
8181 (15) an individual who is employed by the state or a
8282 political subdivision of the state and who is considered by the
8383 governmental employer to be a trainee for a position otherwise
8484 described by this section;
8585 (16) an individual who is employed by the Department
8686 of Public Safety and, as certified by the director, is:
8787 (A) deployed into the field in direct support of
8888 a law enforcement operation, including patrol, investigative,
8989 search and rescue, crime scene, on-site communications, or special
9090 operations; and
9191 (B) given a special assignment in direct support
9292 of operations relating to organized crime, criminal interdiction,
9393 border security, counterterrorism, intelligence, traffic
9494 enforcement, emergency management, regulatory services, or special
9595 investigations; [or]
9696 (17) an individual who is employed by the Parks and
9797 Wildlife Department and, as certified by the executive director of
9898 the Parks and Wildlife Department, is:
9999 (A) deployed into the field in direct support of
100100 a law enforcement operation, including patrol, investigative,
101101 search and rescue, crime scene, on-site communications, or special
102102 operations; and
103103 (B) given a special assignment in direct support
104104 of operations relating to organized crime, criminal interdiction,
105105 border security, counterterrorism, intelligence, traffic
106106 enforcement, emergency management, regulatory services, or special
107107 investigations; or
108108 (18) a member of the Texas military forces who is on
109109 state active duty, as those terms are defined by Section 437.001.
110110 SECTION 2. (a) The change in law made by this Act relating
111111 to the death of a member of the Texas military forces applies only
112112 in relation to a death that occurs on or after the effective date of
113113 this Act. Matters regarding eligibility, payment, and benefits
114114 under Chapter 615, Government Code, in relation to a death that
115115 occurs before the effective date of this Act are governed by the law
116116 in effect on the date the death occurs, and the former law is
117117 continued in effect for that purpose.
118118 (b) Notwithstanding Subsection (a) of this section, the
119119 change in law made by this Act applies in relation to the death of a
120120 member of the Texas military forces that occurs on or after May 31,
121121 2021, if the member died while serving on state active duty as a
122122 result of the disaster declaration issued by the governor under
123123 Section 418.014, Government Code, relating to a surge of
124124 individuals unlawfully crossing the Texas-Mexico border.
125125 SECTION 3. This Act takes effect immediately if it receives
126126 a vote of two-thirds of all the members elected to each house, as
127127 provided by Section 39, Article III, Texas Constitution. If this
128128 Act does not receive the vote necessary for immediate effect, this
129129 Act takes effect September 1, 2023.
