| 7 | 7 | | relating to the reallocation of funding or resources for certain |

| 8 | 8 | | county law enforcement agencies. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 120.003, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 120.003. EXEMPTIONS [DISASTER EXCEPTION]. (a) |
|---|
| 13 | 13 | | Section 120.002 does not apply to a county budget adopted for a |
|---|
| 14 | 14 | | fiscal year in which, or the two fiscal years following the fiscal |
|---|
| 15 | 15 | | year in which, a significant budget reduction from the preceding |
|---|
| 16 | 16 | | fiscal year was caused by a disaster, including a tornado, |
|---|
| 17 | 17 | | hurricane, flood, wildfire, or other calamity, but not including a |
|---|
| 18 | 18 | | drought, epidemic, or pandemic, in an area of the county that was |
|---|
| 19 | 19 | | the subject of a disaster declaration by the governor under Chapter |
|---|
| 20 | 20 | | 418, Government Code, or by the president of the United States. |
|---|
| 21 | 21 | | (b) Section 120.002 does not apply to a county budget that: |
|---|
| 22 | 22 | | (1) reduces the number of peace officer positions in a |
|---|
| 23 | 23 | | law enforcement agency at the request of the elected officer who is |
|---|
| 24 | 24 | | the head of the law enforcement agency; or |
|---|
| 25 | 25 | | (2) reallocates funding, resources, or peace officer |
|---|
| 26 | 26 | | positions: |
|---|
| 27 | 27 | | (A) within a law enforcement agency the head of |
|---|
| 28 | 28 | | which is an elected officer; or |
|---|
| 29 | 29 | | (B) from one law enforcement agency to another |
|---|
| 30 | 30 | | law enforcement agency, the heads of which are both elected |
|---|
| 31 | 31 | | officers. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2023. |
