88 AN ACT
99 relating to the training program required for certain employees of
1010 the Department of Family and Protective Services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 40.035, Human Resources Code, is amended
1313 by amending Subsections (a) and (b) and adding Subsection (a-1) to
1414 read as follows:
1515 (a) The department shall develop and implement a training
1616 program that, except as provided by Subsection (a-1), each newly
1717 hired or assigned department employee must successfully complete
1818 before:
1919 (1) initiating an investigation of a report of alleged
2020 abuse, neglect, or exploitation of an elderly person or person with
2121 a disability under Chapter 48; or
2222 (2) providing protective services to elderly persons
2323 or persons with disabilities under that chapter.
2424 (a-1) A newly hired or assigned department employee may
2525 initiate an investigation of a report of alleged abuse, neglect, or
2626 exploitation of an elderly person or a person with a disability
2727 under Chapter 48 or provide protective services to an elderly
2828 person or a person with a disability under that chapter only if the
2929 employee:
3030 (1) is in the process of receiving the training
3131 required by Subsection (a); and
3232 (2) initiates the investigation or provides
3333 protective services under the direct supervision of the person who
3434 is providing the training to the employee.
3535 (b) The training program must:
3636 (1) provide the employee [person] with appropriate
3737 comprehensive information regarding:
3838 (A) the incidence and types of reports of abuse,
3939 neglect, and exploitation of elderly persons or persons with
4040 disabilities that are received by the department, including
4141 information concerning false reports; and
4242 (B) the use and proper implementation of:
4343 (i) the risk assessment criteria developed
4444 under Section 48.004;
4545 (ii) the criteria used by caseworkers to
4646 determine whether elderly persons or persons with disabilities lack
4747 capacity to consent to receive protective services; and
4848 (iii) the legal procedures available under
4949 Chapter 48 for the protection of elderly persons or persons with
5050 disabilities, including the procedures for obtaining a court order
5151 for emergency protective services under Section 48.208;
5252 (2) include best practices for management of a case
5353 from the intake process to the provision of protective services,
5454 including criteria that specify the circumstances under which an
5555 employee should:
5656 (A) consult a supervisor regarding a case; or
5757 (B) refer an elderly person or person with a
5858 disability to an appropriate public agency or community service
5959 provider for guardianship or other long-term services after the
6060 delivery of protective services to that person has been completed;
6161 (3) provide appropriate specialized training in any
6262 necessary topics, including:
6363 (A) investigation of suspected identity theft
6464 and other forms of financial exploitation and suspected
6565 self-neglect; and
6666 (B) establishment and maintenance of working
6767 relationships with community organizations and other local
6868 providers who provide services to elderly persons and persons with
6969 disabilities;
7070 (4) include on-the-job training, which must require
7171 another department caseworker with more experience to accompany and
7272 train the caseworker in the field;
7373 (5) provide for the development of individualized
7474 training plans;
7575 (6) include training in working with law enforcement
7676 agencies and the court system when legal intervention is sought for
7777 investigations or emergency orders;
7878 (7) to the maximum extent possible, include nationally
7979 recognized best practices in addition to the best practices
8080 required under Subdivision (2); and
8181 (8) include testing, progress reports, or other
8282 evaluations to assess the performance of trainees.
8383 SECTION 2. Section 40.035, Human Resources Code, as amended
8484 by this Act, applies to an employee who is enrolled in the training
8585 program on or after the effective date of this Act.
8686 SECTION 3. This Act takes effect September 1, 2023.
