| 7 | 7 | | relating to Medicaid coverage and reimbursement for certain |

| 8 | 8 | | cancer-related treatments or items. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 32.0427 to read as follows: |
|---|
| 12 | 12 | | Sec. 32.0427. REIMBURSEMENT FOR CERTAIN CANCER-RELATED |
|---|
| 13 | 13 | | TREATMENTS OR ITEMS. The commission shall ensure that medical |
|---|
| 14 | 14 | | assistance reimbursement is provided to a health care provider for |
|---|
| 15 | 15 | | providing the following treatments or items in relation to cancer |
|---|
| 16 | 16 | | treatment: |
|---|
| 17 | 17 | | (1) physical therapy; |
|---|
| 18 | 18 | | (2) dental services related to the effects of |
|---|
| 19 | 19 | | chemotherapy or radiation, including: |
|---|
| 20 | 20 | | (A) oral surgery; |
|---|
| 21 | 21 | | (B) dental implants; |
|---|
| 22 | 22 | | (C) dental veneers; and |
|---|
| 23 | 23 | | (D) dentures; |
|---|
| 24 | 24 | | (3) compression garments, including: |
|---|
| 25 | 25 | | (A) sleeves; |
|---|
| 26 | 26 | | (B) garners; and |
|---|
| 27 | 27 | | (C) gauntlets; and |
|---|
| 28 | 28 | | (4) mastectomy products, including: |
|---|
| 29 | 29 | | (A) shells; |
|---|
| 30 | 30 | | (B) shapers; and |
|---|
| 31 | 31 | | (C) prostheses. |
|---|
| 32 | 32 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 33 | 33 | | a state agency determines that any other waiver or authorization |
|---|
| 34 | 34 | | from a federal agency is necessary for implementation of that |
|---|
| 35 | 35 | | provision, the agency affected by the provision shall request the |
|---|
| 36 | 36 | | waiver or authorization and may delay implementing that provision |
|---|
| 37 | 37 | | until the waiver or authorization is granted. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
