55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to Medicaid coverage and reimbursement for certain
88 cancer-related treatments or items.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.0427 to read as follows:
1212 Sec. 32.0427. REIMBURSEMENT FOR CERTAIN CANCER-RELATED
1313 TREATMENTS OR ITEMS. The commission shall ensure that medical
1414 assistance reimbursement is provided to a health care provider for
1515 providing the following treatments or items in relation to cancer
1616 treatment:
1717 (1) physical therapy;
1818 (2) dental services related to the effects of
1919 chemotherapy or radiation, including:
2020 (A) oral surgery;
2121 (B) dental implants;
2222 (C) dental veneers; and
2323 (D) dentures;
2424 (3) compression garments, including:
2525 (A) sleeves;
2626 (B) garners; and
2727 (C) gauntlets; and
2828 (4) mastectomy products, including:
2929 (A) shells;
3030 (B) shapers; and
3131 (C) prostheses.
3232 SECTION 2. If before implementing any provision of this Act
3333 a state agency determines that any other waiver or authorization
3434 from a federal agency is necessary for implementation of that
3535 provision, the agency affected by the provision shall request the
3636 waiver or authorization and may delay implementing that provision
3737 until the waiver or authorization is granted.
3838 SECTION 3. This Act takes effect September 1, 2023.
