55 AN ACT
66 relating to the eligibility of certain criminal defendants for an
77 order of nondisclosure of criminal history record information.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 411.0725(e), Government Code, is amended
1010 to read as follows:
1111 (e) A person may petition the court that placed the person
1212 on deferred adjudication community supervision for an order of
1313 nondisclosure of criminal history record information under this
1414 section only on or after:
1515 (1) the discharge and dismissal, if the offense for
1616 which the person was placed on deferred adjudication was a
1717 misdemeanor other than a misdemeanor described by Subdivision (3)
1818 [(2)];
1919 (2) the first anniversary of the discharge and
2020 dismissal, if the offense for which the person was placed on
2121 deferred adjudication was a state jail felony other than a state
2222 jail felony under Chapter 20, 21, 22, 25, 42, 43, 46, 49, or 71,
2323 Penal Code;
2424 (3) the second anniversary of the discharge and
2525 dismissal, if the offense for which the person was placed on
2626 deferred adjudication was a misdemeanor under Chapter 20, 21, 22,
2727 25, 42, 43, or 46, Penal Code; or
2828 (4) [(3)] the third [fifth] anniversary of the
2929 discharge and dismissal, if the offense for which the person was
3030 placed on deferred adjudication was a felony other than a state jail
3131 felony described by Subdivision (2).
3232 SECTION 2. The heading to Section 411.073, Government Code,
3333 is amended to read as follows:
3434 Sec. 411.073. PROCEDURE FOR COMMUNITY SUPERVISION
3535 FOLLOWING CONVICTION; CERTAIN MISDEMEANORS AND STATE JAIL
3636 FELONIES.
3737 SECTION 3. Section 411.073, Government Code, is amended by
3838 amending Subsections (a) and (d) and adding Subsection (e) to read
3939 as follows:
4040 (a) This section applies only to a person placed on
4141 community supervision under Chapter 42A, Code of Criminal
4242 Procedure:
4343 (1) following a conviction of:
4444 (A) a misdemeanor other than a misdemeanor under
4545 Section 106.041, Alcoholic Beverage Code, Section 49.04, 49.05,
4646 49.06, or 49.065, Penal Code, or Chapter 71, Penal Code; or
4747 (B) a state jail felony other than a state jail
4848 felony under Chapter 20, 21, 22, 25, 42, 43, 46, 49, or 71, Penal
4949 Code; and
5050 (2) under a provision of Chapter 42A, Code of Criminal
5151 Procedure, other than Subchapter C, including:
5252 (A) a provision that requires the person to serve
5353 a term of confinement as a condition of community supervision; or
5454 (B) another provision that authorizes placing a
5555 person on community supervision after the person has served part of
5656 a term of confinement imposed for the offense.
5757 (d) A person may petition the court that placed the person
5858 on community supervision for an order of nondisclosure of criminal
5959 history record information under this section only on or after:
6060 (1) the completion of the community supervision, if
6161 the offense for which the person was placed on community
6262 supervision was a misdemeanor other than a misdemeanor described by
6363 Subdivision (3) [(2)]; [or]
6464 (2) the first anniversary of the date of completion of
6565 the community supervision, if the offense for which the person was
6666 placed on community supervision was a state jail felony; or
6767 (3) the second anniversary of the date of completion
6868 of the community supervision, if the offense for which the person
6969 was placed on community supervision was a misdemeanor under Chapter
7070 20, 21, 22, 25, 42, 43, or 46, Penal Code.
7171 (e) A court that issues an order of nondisclosure of
7272 criminal history record information may include in the order any
7373 offense arising out of the same transaction as the offense for which
7474 the order is sought if the other offense:
7575 (1) satisfies the requirements for issuance of an
7676 order of nondisclosure of criminal history record information under
7777 this section or another provision of this subchapter; or
7878 (2) has not resulted in a conviction or a dismissal and
7979 discharge under Article 42A.111, Code of Criminal Procedure, and is
8080 no longer pending.
8181 SECTION 4. The heading to Section 411.0735, Government
8282 Code, is amended to read as follows:
8383 Sec. 411.0735. PROCEDURE FOR CONVICTION; CERTAIN
8484 MISDEMEANORS AND STATE JAIL FELONIES.
8585 SECTION 5. Section 411.0735, Government Code, is amended by
8686 amending Subsections (a) and (d) and adding Subsection (e) to read
8787 as follows:
8888 (a) This section applies only to a person who:
8989 (1) is convicted of:
9090 (A) a misdemeanor other than a misdemeanor under
9191 Section 106.041, Alcoholic Beverage Code, Section 49.04, 49.05,
9292 49.06, or 49.065, Penal Code, or Chapter 71, Penal Code; or
9393 (B) a state jail felony other than a state jail
9494 felony under Chapter 20, 21, 22, 25, 42, 43, 46, 49, or 71, Penal
9595 Code; and
9696 (2) is not eligible for an order of nondisclosure of
9797 criminal history record information under Section 411.073.
9898 (d) A person may petition the court that imposed the
9999 sentence for an order of nondisclosure of criminal history record
100100 information under this section only on or after:
101101 (1) the date of completion of the person's sentence, if
102102 the offense of which the person was convicted was a misdemeanor
103103 punishable by fine only; [or]
104104 (2) the first [second] anniversary of the date of
105105 completion of the person's sentence, if the offense of which the
106106 person was convicted was a misdemeanor other than a misdemeanor
107107 described by Subdivision (1) or (3)(A); or
108108 (3) the second anniversary of the date of completion
109109 of the person's sentence, if the offense of which the person was
110110 convicted was:
111111 (A) a misdemeanor under Chapter 20, 21, 22, 25,
112112 42, 43, or 46, Penal Code; or
113113 (B) a state jail felony.
114114 (e) A court that issues an order of nondisclosure of
115115 criminal history record information may include in the order any
116116 offense arising out of the same transaction as the offense for which
117117 the order is sought if the other offense:
118118 (1) satisfies the requirements for issuance of an
119119 order of nondisclosure of criminal history record information under
120120 this section or another provision of this subchapter; or
121121 (2) has not resulted in a conviction or a dismissal and
122122 discharge under Article 42A.111, Code of Criminal Procedure, and is
123123 no longer pending.
124124 SECTION 6. Subchapter E-1, Chapter 411, Government Code, is
125125 amended by adding Section 411.0738 to read as follows:
126126 Sec. 411.0738. PROCEDURE FOR MORE THAN ONE CONVICTION.
127127 (a) This section applies only to a person who:
128128 (1) has more than one conviction for an offense that is
129129 a misdemeanor or state jail felony other than:
130130 (A) a misdemeanor under Section 106.041,
131131 Alcoholic Beverage Code, Section 49.04, 49.05, 49.06, or 49.065,
132132 Penal Code, or Chapter 71, Penal Code; or
133133 (B) a state jail felony under Chapter 19, 20, 21,
134134 22, 25, 42, 43, 46, 49, or 71, Penal Code; and
135135 (2) is not eligible for an order of nondisclosure of
136136 criminal history record information under Section 411.073 or
137137 411.0735.
138138 (b) Notwithstanding any other provision of this subchapter
139139 or Subchapter F, a person described by Subsection (a) who has
140140 completed each sentence imposed, including any term of confinement
141141 or period of community supervision imposed and payment of all
142142 fines, costs, and restitution imposed, may petition any court that
143143 imposed at least one of those sentences for an order of
144144 nondisclosure of criminal history record information under this
145145 section if the person satisfies the requirements of this section
146146 and Section 411.074.
147147 (c) Except as provided by Subsection (d), after notice to
148148 the state, an opportunity for a hearing, and a determination that
149149 the person is entitled to file the petition and issuance of the
150150 order is in the best interest of justice, the court shall issue an
151151 order prohibiting criminal justice agencies from disclosing to the
152152 public criminal history record information related to the offenses
153153 for which the person was convicted.
154154 (d) A court may issue an order of nondisclosure of criminal
155155 history record information under this section for a misdemeanor
156156 under Chapter 20, 21, 22, 25, 42, 43, or 46, Penal Code, other than a
157157 misdemeanor under Section 22.01 of that code, only if the person:
158158 (1) was placed on community supervision for the
159159 offense; and
160160 (2) completed the period of community supervision
161161 imposed for the offense.
162162 (e) A person may petition a court described by Subsection
163163 (b) for an order of nondisclosure of criminal history record
164164 information under this section only on or after:
165165 (1) the third anniversary of the date of the
166166 completion of all sentences imposed if the most serious offense for
167167 which the order is sought is a misdemeanor;
168168 (2) the fourth anniversary of the date of the
169169 completion of all sentences imposed if:
170170 (A) the most serious offense for which the order
171171 is sought is a state jail felony; and
172172 (B) the person's last sentence included a period
173173 of community supervision that the person completed; or
174174 (3) if neither Subdivision (1) nor (2) applies, the
175175 fifth anniversary of the date of the completion of all sentences
176176 imposed.
177177 SECTION 7. This Act takes effect September 1, 2023.
