55 AN ACT
66 relating to prohibiting certain sales and purchases of firearms;
77 creating criminal offenses; providing a civil penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 46.06, Penal Code, is amended by
1010 amending Subsections (a) and (d) and adding Subsection (c-1) to
1111 read as follows:
1212 (a) A person commits an offense if the person:
1313 (1) sells, rents, leases, loans, or gives a handgun to
1414 any person knowing that the person to whom the handgun is to be
1515 delivered intends to use it unlawfully or in the commission of an
1616 unlawful act;
1717 (2) intentionally or knowingly sells, rents, leases,
1818 or gives or offers to sell, rent, lease, or give to any child
1919 younger than 18 years of age any firearm, club, or
2020 location-restricted knife;
2121 (2-a) knowingly sells a firearm to a person 18 years of
2222 age or older but younger than 21 years of age;
2323 (3) intentionally, knowingly, or recklessly sells a
2424 firearm or ammunition for a firearm to any person who is
2525 intoxicated; (4) knowingly sells a firearm or ammunition for a
2626 firearm to any person who has been convicted of a felony before the
2727 fifth anniversary of the later of the following dates:
2828 (A) the person's release from confinement
2929 following conviction of the felony; or
3030 (B) the person's release from supervision under
3131 community supervision, parole, or mandatory supervision following
3232 conviction of the felony;
3333 (5) sells, rents, leases, loans, or gives a handgun to
3434 any person knowing that an active protective order is directed to
3535 the person to whom the handgun is to be delivered;
3636 (6) knowingly purchases, rents, leases, or receives as
3737 a loan or gift from another a handgun while an active protective
3838 order is directed to the actor; or
3939 (7) while prohibited from possessing a firearm under
4040 state or federal law, knowingly makes a material false statement on
4141 a form that is:
4242 (A) required by state or federal law for the
4343 purchase, sale, or other transfer of a firearm; and
4444 (B) submitted to a licensed firearms dealer, as
4545 defined by 18 U.S.C. Section 923.
4646 firearm to any person who has been convicted of a felony before the
4747 fifth anniversary of the later of the following dates:
4848 (A) the person's release from confinement
4949 following conviction of the felony; or
5050 firearm to any person who has been convicted of a felony before the
5151 fifth anniversary of the later of the following dates:
5252 (A) the person's release from confinement
5353 following conviction of the felony; or
5454 (c-1) It is an exception to the application of Subsection
5555 (a)(2-a) that the firearm is sold to a person who holds a license to
5656 carry a handgun issued under Subchapter H, Chapter 411, Government
5757 Code.
5858 (d) An offense under this section is a Class A misdemeanor,
5959 except that:
6060 (1) an offense under Subsection (a)(2) is a state jail
6161 felony if the weapon that is the subject of the offense is a
6262 handgun; [and]
6363 (2) an offense under Subsection (a)(2-a) is a felony
6464 of the third degree; and
6565 (3) an offense under Subsection (a)(7) is a state jail
6666 felony.
6767 SECTION 2. Chapter 46, Penal Code, is amended by adding
6868 Section 46.065 to read as follows:
6969 Sec. 46.065. UNLAWFUL PURCHASE OF FIREARM. (a) A person
7070 who is 18 years of age or older but younger than 21 years of age
7171 commits an offense if the person knowingly purchases a firearm.
7272 (b) It is an exception to the application of Subsection (a)
7373 that the person holds a license to carry a handgun issued under
7474 Subchapter H, Chapter 411, Government Code.
7575 (c) An offense under Subsection (a) is a felony of the third
7676 degree.
7777 SECTION 3. The change in law made by this Act applies only
7878 to an offense committed on or after the effective date of this Act.
7979 An offense committed before the effective date of this Act is
8080 governed by the law in effect on the date the offense was committed,
8181 and the former law is continued in effect for that purpose. For
8282 purposes of this section, an offense was committed before the
8383 effective date of this Act if any element of the offense occurred
8484 before that date.
8585 SECTION 4. This Act takes effect September 1, 2023.
