| 7 | 7 | | relating to continuing education requirements for dentists |
|---|
| 8 | 8 | | regarding pain management with certain prescription medications. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 257.005, Occupations Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (b-1) and adding Subsections (d), (e), (f), |
|---|
| 12 | 12 | | (g), and (h) to read as follows: |
|---|
| 13 | 13 | | (b-1) The board shall require a licensed dentist whose |
|---|
| 14 | 14 | | practice includes direct patient care to complete, in accordance |
|---|
| 15 | 15 | | with this section, not less than two hours of board-approved |
|---|
| 16 | 16 | | continuing education [annually] regarding safe and effective pain |
|---|
| 17 | 17 | | management related to the prescription of opioids and other |
|---|
| 18 | 18 | | controlled substances, including education regarding: |
|---|
| 19 | 19 | | (1) reasonable standards of care; |
|---|
| 20 | 20 | | (2) the identification of drug-seeking behavior in |
|---|
| 21 | 21 | | patients; and |
|---|
| 22 | 22 | | (3) effectively communicating with patients regarding |
|---|
| 23 | 23 | | the prescription of an opioid or other controlled substance. |
|---|
| 24 | 24 | | (d) A dentist must complete the hours required by Subsection |
|---|
| 25 | 25 | | (b-1) in each of the first two renewal periods following the |
|---|
| 26 | 26 | | issuance of the dentist's initial license, with two of those hours |
|---|
| 27 | 27 | | to be completed not later than the first anniversary of the date of |
|---|
| 28 | 28 | | issuance. |
|---|
| 29 | 29 | | (e) After the period described by Subsection (d), a dentist |
|---|
| 30 | 30 | | must complete not less than two hours of continuing education |
|---|
| 31 | 31 | | described by Subsection (b-1) every eight years. |
|---|
| 32 | 32 | | (f) The hours required by this section may be completed in |
|---|
| 33 | 33 | | any continuing education program approved by the board. |
|---|
| 34 | 34 | | (g) The hours required by this section may not be used to |
|---|
| 35 | 35 | | satisfy any education requirement established by board rule for |
|---|
| 36 | 36 | | certified pain clinic personnel. |
|---|
| 37 | 37 | | (h) Notwithstanding Subsections (d) and (e), a dentist who |
|---|
| 38 | 38 | | on September 1, 2023, holds a license to practice under this |
|---|
| 39 | 39 | | subtitle shall complete not less than two hours of continuing |
|---|
| 40 | 40 | | education described by Subsection (b-1) in each of the two renewal |
|---|
| 41 | 41 | | periods occurring after that date. This subsection expires January |
|---|
| 42 | 42 | | 1, 2028. |

| 43 | 43 | | SECTION 2. (a) Not later than January 1, 2024, the State |
|---|
| 44 | 44 | | Board of Dental Examiners shall adopt rules necessary to implement |
|---|
| 45 | 45 | | Section 257.005, Occupations Code, as amended by this Act. |
|---|
| 46 | 46 | | (b) Section 257.005, Occupations Code, as amended by this |
|---|
| 47 | 47 | | Act, applies only to an application for renewal of a license |
|---|
| 48 | 48 | | submitted on or after January 1, 2024. A renewal application |
|---|
| 49 | 49 | | submitted before January 1, 2024, is governed by the law in effect |
|---|
| 50 | 50 | | immediately before the effective date of this Act, and the former |
|---|
| 51 | 51 | | law is continued in effect for that purpose. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect September 1, 2023. |
