55 relating to the commissioning of peace officers by certain private
66 schools.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 37, Education Code, is
99 amended by adding Section 37.0818 to read as follows:
1010 Sec. 37.0818. PRIVATE SCHOOL PEACE OFFICERS. (a) This
1111 section applies only to a private school that has an enrollment of
1212 at least 1,500 students.
1313 (b) The governing body of a private school to which this
1414 section applies may commission peace officers to enforce state and
1515 local law on a campus of the school.
1616 (c) A peace officer commissioned by a private school under
1717 this section must meet all minimum standards for peace officers
1818 established by the Texas Commission on Law Enforcement.
1919 SECTION 2. Article 2.12, Code of Criminal Procedure, is
2020 amended to read as follows:
2121 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
2222 officers:
2323 (1) sheriffs, their deputies, and those reserve
2424 deputies who hold a permanent peace officer license issued under
2525 Chapter 1701, Occupations Code;
2626 (2) constables, deputy constables, and those reserve
2727 deputy constables who hold a permanent peace officer license issued
2828 under Chapter 1701, Occupations Code;
2929 (3) marshals or police officers of an incorporated
3030 city, town, or village, and those reserve municipal police officers
3131 who hold a permanent peace officer license issued under Chapter
3232 1701, Occupations Code;
3333 (4) rangers, officers, and members of the reserve
3434 officer corps commissioned by the Public Safety Commission and the
3535 Director of the Department of Public Safety;
3636 (5) investigators of the district attorneys', criminal
3737 district attorneys', and county attorneys' offices;
3838 (6) law enforcement agents of the Texas Alcoholic
3939 Beverage Commission;
4040 (7) each member of an arson investigating unit
4141 commissioned by a city, a county, or the state;
4242 (8) officers commissioned under Section 37.081 or
4343 37.0818, Education Code, or Subchapter E, Chapter 51, Education
4444 Code;
4545 (9) officers commissioned by the General Services
4646 Commission;
4747 (10) law enforcement officers commissioned by the
4848 Parks and Wildlife Commission;
4949 (11) officers commissioned under Chapter 23,
5050 Transportation Code;
5151 (12) municipal park and recreational patrolmen and
5252 security officers;
5353 (13) security officers and investigators commissioned
5454 as peace officers by the comptroller;
5555 (14) officers commissioned by a water control and
5656 improvement district under Section 49.216, Water Code;
5757 (15) officers commissioned by a board of trustees
5858 under Chapter 54, Transportation Code;
5959 (16) investigators commissioned by the Texas Medical
6060 Board;
6161 (17) officers commissioned by:
6262 (A) the board of managers of the Dallas County
6363 Hospital District, the Tarrant County Hospital District, the Bexar
6464 County Hospital District, or the El Paso County Hospital District
6565 under Section 281.057, Health and Safety Code;
6666 (B) the board of directors of the Ector County
6767 Hospital District under Section 1024.117, Special District Local
6868 Laws Code;
6969 (C) the board of directors of the Midland County
7070 Hospital District of Midland County, Texas, under Section 1061.121,
7171 Special District Local Laws Code; and
7272 (D) the board of hospital managers of the Lubbock
7373 County Hospital District of Lubbock County, Texas, under Section
7474 1053.113, Special District Local Laws Code;
7575 (18) county park rangers commissioned under
7676 Subchapter E, Chapter 351, Local Government Code;
7777 (19) investigators employed by the Texas Racing
7878 Commission;
7979 (20) officers commissioned under Chapter 554,
8080 Occupations Code;
8181 (21) officers commissioned by the governing body of a
8282 metropolitan rapid transit authority under Section 451.108,
8383 Transportation Code, or by a regional transportation authority
8484 under Section 452.110, Transportation Code;
8585 (22) investigators commissioned by the attorney
8686 general under Section 402.009, Government Code;
8787 (23) security officers and investigators commissioned
8888 as peace officers under Chapter 466, Government Code;
8989 (24) officers appointed by an appellate court under
9090 Subchapter F, Chapter 53, Government Code;
9191 (25) officers commissioned by the state fire marshal
9292 under Chapter 417, Government Code;
9393 (26) an investigator commissioned by the commissioner
9494 of insurance under Section 701.104, Insurance Code;
9595 (27) apprehension specialists and inspectors general
9696 commissioned by the Texas Juvenile Justice Department as officers
9797 under Sections 242.102 and 243.052, Human Resources Code;
9898 (28) officers appointed by the inspector general of
9999 the Texas Department of Criminal Justice under Section 493.019,
100100 Government Code;
101101 (29) investigators commissioned by the Texas
102102 Commission on Law Enforcement under Section 1701.160, Occupations
103103 Code;
104104 (30) commission investigators commissioned by the
105105 Texas Private Security Board under Section 1702.061, Occupations
106106 Code;
107107 (31) the fire marshal and any officers, inspectors, or
108108 investigators commissioned by an emergency services district under
109109 Chapter 775, Health and Safety Code;
110110 (32) officers commissioned by the State Board of
111111 Dental Examiners under Section 254.013, Occupations Code, subject
112112 to the limitations imposed by that section;
113113 (33) investigators commissioned by the Texas Juvenile
114114 Justice Department as officers under Section 221.011, Human
115115 Resources Code; and
116116 (34) the fire marshal and any related officers,
117117 inspectors, or investigators commissioned by a county under
118118 Subchapter B, Chapter 352, Local Government Code.
119119 SECTION 3. This Act takes effect September 1, 2023.
