5	5	relating to the commissioning of peace officers by certain private
6	6	schools.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Subchapter C, Chapter 37, Education Code, is
9	9	amended by adding Section 37.0818 to read as follows:
10	10	Sec. 37.0818. PRIVATE SCHOOL PEACE OFFICERS. (a) This
11	11	section applies only to a private school that has an enrollment of
12	12	at least 1,500 students.
13	13	(b) The governing body of a private school to which this
14	14	section applies may commission peace officers to enforce state and
15	15	local law on a campus of the school.
16	16	(c) A peace officer commissioned by a private school under
17	17	this section must meet all minimum standards for peace officers
18	18	established by the Texas Commission on Law Enforcement.
19	19	SECTION 2. Article 2.12, Code of Criminal Procedure, is
20	20	amended to read as follows:
21	21	Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
22	22	officers:
23	23	(1) sheriffs, their deputies, and those reserve
24	24	deputies who hold a permanent peace officer license issued under
25	25	Chapter 1701, Occupations Code;
26	26	(2) constables, deputy constables, and those reserve
27	27	deputy constables who hold a permanent peace officer license issued
28	28	under Chapter 1701, Occupations Code;
29	29	(3) marshals or police officers of an incorporated
30	30	city, town, or village, and those reserve municipal police officers
31	31	who hold a permanent peace officer license issued under Chapter
32	32	1701, Occupations Code;
33	33	(4) rangers, officers, and members of the reserve
34	34	officer corps commissioned by the Public Safety Commission and the
35	35	Director of the Department of Public Safety;
36	36	(5) investigators of the district attorneys', criminal
37	37	district attorneys', and county attorneys' offices;
38	38	(6) law enforcement agents of the Texas Alcoholic
39	39	Beverage Commission;
40	40	(7) each member of an arson investigating unit
41	41	commissioned by a city, a county, or the state;
42	42	(8) officers commissioned under Section 37.081 or
43	43	37.0818, Education Code, or Subchapter E, Chapter 51, Education
44	44	Code;
45	45	(9) officers commissioned by the General Services
46	46	Commission;
47	47	(10) law enforcement officers commissioned by the
48	48	Parks and Wildlife Commission;
49	49	(11) officers commissioned under Chapter 23,
50	50	Transportation Code;
51	51	(12) municipal park and recreational patrolmen and
52	52	security officers;
53	53	(13) security officers and investigators commissioned
54	54	as peace officers by the comptroller;
55	55	(14) officers commissioned by a water control and
56	56	improvement district under Section 49.216, Water Code;
57	57	(15) officers commissioned by a board of trustees
58	58	under Chapter 54, Transportation Code;
59	59	(16) investigators commissioned by the Texas Medical
60	60	Board;
61	61	(17) officers commissioned by:
62	62	(A) the board of managers of the Dallas County
63	63	Hospital District, the Tarrant County Hospital District, the Bexar
64	64	County Hospital District, or the El Paso County Hospital District
65	65	under Section 281.057, Health and Safety Code;
66	66	(B) the board of directors of the Ector County
67	67	Hospital District under Section 1024.117, Special District Local
68	68	Laws Code;
69	69	(C) the board of directors of the Midland County
70	70	Hospital District of Midland County, Texas, under Section 1061.121,
71	71	Special District Local Laws Code; and
72	72	(D) the board of hospital managers of the Lubbock
73	73	County Hospital District of Lubbock County, Texas, under Section
74	74	1053.113, Special District Local Laws Code;
75	75	(18) county park rangers commissioned under
76	76	Subchapter E, Chapter 351, Local Government Code;
77	77	(19) investigators employed by the Texas Racing
78	78	Commission;
79	79	(20) officers commissioned under Chapter 554,
80	80	Occupations Code;
81	81	(21) officers commissioned by the governing body of a
82	82	metropolitan rapid transit authority under Section 451.108,
83	83	Transportation Code, or by a regional transportation authority
84	84	under Section 452.110, Transportation Code;
85	85	(22) investigators commissioned by the attorney
86	86	general under Section 402.009, Government Code;
87	87	(23) security officers and investigators commissioned
88	88	as peace officers under Chapter 466, Government Code;
89	89	(24) officers appointed by an appellate court under
90	90	Subchapter F, Chapter 53, Government Code;
91	91	(25) officers commissioned by the state fire marshal
92	92	under Chapter 417, Government Code;
93	93	(26) an investigator commissioned by the commissioner
94	94	of insurance under Section 701.104, Insurance Code;
95	95	(27) apprehension specialists and inspectors general
96	96	commissioned by the Texas Juvenile Justice Department as officers
97	97	under Sections 242.102 and 243.052, Human Resources Code;
98	98	(28) officers appointed by the inspector general of
99	99	the Texas Department of Criminal Justice under Section 493.019,
100	100	Government Code;
101	101	(29) investigators commissioned by the Texas
102	102	Commission on Law Enforcement under Section 1701.160, Occupations
103	103	Code;
104	104	(30) commission investigators commissioned by the
105	105	Texas Private Security Board under Section 1702.061, Occupations
106	106	Code;
107	107	(31) the fire marshal and any officers, inspectors, or
108	108	investigators commissioned by an emergency services district under
109	109	Chapter 775, Health and Safety Code;
110	110	(32) officers commissioned by the State Board of
111	111	Dental Examiners under Section 254.013, Occupations Code, subject
112	112	to the limitations imposed by that section;
113	113	(33) investigators commissioned by the Texas Juvenile
114	114	Justice Department as officers under Section 221.011, Human
115	115	Resources Code; and
116	116	(34) the fire marshal and any related officers,
117	117	inspectors, or investigators commissioned by a county under
118	118	Subchapter B, Chapter 352, Local Government Code.
119	119	SECTION 3. This Act takes effect September 1, 2023.
