| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 13.242(c), Water Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (c) The utility commission may by rule allow a municipality |
|---|
| 11 | 11 | | or utility or water supply corporation to render retail water |
|---|
| 12 | 12 | | service without a certificate of public convenience and necessity |
|---|
| 13 | 13 | | if the municipality has given notice under Section 13.255 that it |
|---|
| 14 | 14 | | intends to provide retail water service to an area or if the utility |
|---|
| 15 | 15 | | or water supply corporation has less than 15 potential connections |
|---|
| 16 | 16 | | and is not within the certificated area of another retail public |
|---|
| 17 | 17 | | utility. The utility commission may by rule allow a municipality or |
|---|
| 18 | 18 | | utility or water supply corporation to render retail sewer service |
|---|
| 19 | 19 | | without a certificate of public convenience and necessity if the |
|---|
| 20 | 20 | | municipality has given notice under Section 13.255 that it intends |
|---|
| 21 | 21 | | to provide retail sewer service to an area or if the utility or |
|---|
| 22 | 22 | | water supply corporation has less than 15 potential connections and |
|---|
| 23 | 23 | | is not within the certificated area of another retail public |
|---|
| 24 | 24 | | utility. |

| 25 | 25 | | SECTION 2. This Act takes effect September 1, 2023. |
