55 relating to the provision of sewer service without a certificate of

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 13.242(c), Water Code, is amended to
99 read as follows:
1010 (c) The utility commission may by rule allow a municipality
1111 or utility or water supply corporation to render retail water
1212 service without a certificate of public convenience and necessity
1313 if the municipality has given notice under Section 13.255 that it
1414 intends to provide retail water service to an area or if the utility
1515 or water supply corporation has less than 15 potential connections
1616 and is not within the certificated area of another retail public
1717 utility. The utility commission may by rule allow a municipality or
1818 utility or water supply corporation to render retail sewer service
1919 without a certificate of public convenience and necessity if the
2020 municipality has given notice under Section 13.255 that it intends
2121 to provide retail sewer service to an area or if the utility or
2222 water supply corporation has less than 15 potential connections and
2323 is not within the certificated area of another retail public
2424 utility.
2525 SECTION 2. This Act takes effect September 1, 2023.
