| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 222, Transportation Code, is amended by |
|---|
| 11 | 11 | | adding Section 222.0012 to read as follows: |

| 12 | 12 | | Sec. 222.0012. CERTAIN IMPROVEMENTS OF STATE HIGHWAY SYSTEM |
|---|
| 13 | 13 | | IN CERTAIN CENSUS TRACTS PROHIBITED. (a) Notwithstanding any |
|---|
| 14 | 14 | | other law, and subject to Subsection (b), money described by |
|---|
| 15 | 15 | | Section 222.001(a) may not be used to expand or extend a highway of |
|---|
| 16 | 16 | | the state highway system unless the department determines that the |
|---|
| 17 | 17 | | expansion or extension is not located in a census tract classified |
|---|
| 18 | 18 | | as medium or high vulnerability in the most recent social |
|---|
| 19 | 19 | | vulnerability index published by the federal Centers for Disease |
|---|
| 20 | 20 | | Control and Prevention and the Agency for Toxic Substances and |
|---|
| 21 | 21 | | Disease Registry. |
|---|
| 22 | 22 | | (b) Subsection (a) does not apply to a multimodal |
|---|
| 23 | 23 | | transportation project. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
