1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the Texas Industry-Recognized Apprenticeship Programs
1414 Grant Program.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 302.252(1), Labor Code, is amended to
1717 read as follows:
1818 (1) "Industry-recognized apprenticeship program"
1919 means a training program that [:
2020 [(A) provides on-the-job training, preparatory
2121 instruction, supplementary instruction, or related instruction in
2222 an occupation that has been recognized as an apprenticeable
2323 occupation by the Office of Apprenticeship of the United States
2424 Department of Labor; or
2525 [(B)] is certified by the commission as an
2626 industry-recognized apprenticeship program [by a third-party
2727 certifier that has received from the United States Department of
2828 Labor a favorable determination of qualification to award that
2929 certification].
3030 SECTION 2. Section 302.257, Labor Code, is amended by
3131 amending Subsection (a) and adding Subsection (a-1) to read as
3232 follows:
3333 (a) The commission shall adopt rules to administer and
3434 enforce this subchapter, including rules establishing the criteria
3535 and process for the commission to certify a training program as an
3636 industry-recognized apprenticeship program for purposes of this
3737 subchapter.
3838 (a-1) The certification criteria established under
3939 Subsection (a) must include that the training program:
4040 (1) lead to the attainment of skills that:
4141 (A) are customarily learned in a practical way
4242 through a structured, systematic program of on-the-job supervised
4343 training; and
4444 (B) are clearly identified and commonly
4545 recognized throughout an industry;
4646 (2) involve manual, mechanical, or technical skills or
4747 knowledge requiring significant on-the-job work experience; and
4848 (3) require related instruction to supplement the
4949 on-the-job training.
5050 SECTION 3. As soon as practicable after the effective date
5151 of this Act, the Texas Workforce Commission shall adopt the rules
5252 required by Section 302.257, Labor Code, as amended by this Act.
5353 SECTION 4. The change in law made by this Act applies only
5454 to a grant awarded under Subchapter I, Chapter 302, Labor Code, on
5555 or after the effective date of this Act. A grant awarded before
5656 that date is governed by the law in effect on the date the grant was
5757 awarded, and the former law is continued in effect for that purpose.
5858 SECTION 5. This Act takes effect September 1, 2023.
