5	5	AN ACT
6	6	relating to the plan for the operation of a central counting
7	7	station.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 127.007, Election Code, is amended by
10	10	amending Subsections (b) and (c) and adding Subsections (d) and (e)
11	11	to read as follows:
12	12	(b) The plan required under this section must include:
13	13	(1) information on [address] the process for comparing
14	14	the number of voters who signed the combination form or electronic
15	15	poll list with the number of votes cast for the entire election;
16	16	(2) who will provide information to the presiding
17	17	judge of the central counting station to complete the
18	18	reconciliation of votes and voters conducted under Section
19	19	127.131(f);
20	20	(3) the date, time, and location of the second and
21	21	third logic and accuracy tests to be conducted at the central
22	22	counting station or regional tabulating center serving the central
23	23	counting station and the procedures regarding an unsuccessful logic
24	24	and accuracy test;
25	25	(4) the date, time, and place the central counting
26	26	station will operate before, on, and after election day, as
27	27	applicable;
28	28	(5) the names of the tabulation supervisor, central
29	29	counting station manager, presiding judge, and alternate presiding
30	30	judge and the party affiliations of the presiding judge and
31	31	alternate presiding judge in the central counting station and
32	32	regional tabulating center serving the central counting station, as
33	33	applicable;
34	34	(6) the procedures regarding ballot security,
35	35	including ballot storage and chain of custody procedures from the
36	36	time the central counting station or regional tabulating center
37	37	receives a sealed ballot box under Section 127.068 through the
38	38	period for preserving the precinct election records under Section
39	39	66.058; and
40	40	(7) information regarding the livestream available to
41	41	the public under Section 127.1232.
42	42	(c) Not later than the fifth day before election day:
43	43	(1) the [The] plan required under this section must be
44	44	posted on the county's Internet website in the same location that
45	45	the county clerk provides information on elections held by the
46	46	county; and
47	47	(2) a copy of the plan, including the contact
48	48	information of the persons described by Subsection (b)(5), must be
49	49	provided to the members of the county election board [available to
50	50	the public on request not later than 5 p.m. on the fifth day before
51	51	the date of the election].
52	52	(d) If a plan required by this section is revised after the
53	53	date the plan is posted in accordance with Subsection (c), the
54	54	county's Internet website must be updated to include:
55	55	(1) the plan with the incorporated revisions; and
56	56	(2) either:
57	57	(A) a list with the date of each revision and the
58	58	section revised; or
59	59	(B) a revised version of the plan conspicuously
60	60	displaying each revision and the date of those revisions.
61	61	(e) The contact information of a person described by
62	62	Subsection (b)(5) is not subject to disclosure under Chapter 552,
63	63	Government Code.
64	64	SECTION 2. This Act takes effect September 1, 2023.
