44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the plan for the operation of a central counting
77 station.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 127.007, Election Code, is amended by
1010 amending Subsections (b) and (c) and adding Subsections (d) and (e)
1111 to read as follows:
1212 (b) The plan required under this section must include:
1313 (1) information on [address] the process for comparing
1414 the number of voters who signed the combination form or electronic
1515 poll list with the number of votes cast for the entire election;
1616 (2) who will provide information to the presiding
1717 judge of the central counting station to complete the
1818 reconciliation of votes and voters conducted under Section
1919 127.131(f);
2020 (3) the date, time, and location of the second and
2121 third logic and accuracy tests to be conducted at the central
2222 counting station or regional tabulating center serving the central
2323 counting station and the procedures regarding an unsuccessful logic
2424 and accuracy test;
2525 (4) the date, time, and place the central counting
2626 station will operate before, on, and after election day, as
2727 applicable;
2828 (5) the names of the tabulation supervisor, central
2929 counting station manager, presiding judge, and alternate presiding
3030 judge and the party affiliations of the presiding judge and
3131 alternate presiding judge in the central counting station and
3232 regional tabulating center serving the central counting station, as
3333 applicable;
3434 (6) the procedures regarding ballot security,
3535 including ballot storage and chain of custody procedures from the
3636 time the central counting station or regional tabulating center
3737 receives a sealed ballot box under Section 127.068 through the
3838 period for preserving the precinct election records under Section
3939 66.058; and
4040 (7) information regarding the livestream available to
4141 the public under Section 127.1232.
4242 (c) Not later than the fifth day before election day:
4343 (1) the [The] plan required under this section must be
4444 posted on the county's Internet website in the same location that
4545 the county clerk provides information on elections held by the
4646 county; and
4747 (2) a copy of the plan, including the contact
4848 information of the persons described by Subsection (b)(5), must be
4949 provided to the members of the county election board [available to
5050 the public on request not later than 5 p.m. on the fifth day before
5151 the date of the election].
5252 (d) If a plan required by this section is revised after the
5353 date the plan is posted in accordance with Subsection (c), the
5454 county's Internet website must be updated to include:
5555 (1) the plan with the incorporated revisions; and
5656 (2) either:
5757 (A) a list with the date of each revision and the
5858 section revised; or
5959 (B) a revised version of the plan conspicuously
6060 displaying each revision and the date of those revisions.
6161 (e) The contact information of a person described by
6262 Subsection (b)(5) is not subject to disclosure under Chapter 552,
6363 Government Code.
6464 SECTION 2. This Act takes effect September 1, 2023.
