44 AN ACT
55 relating to provider discrimination against a Medicaid recipient or
66 child health plan program enrollee based on immunization status.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 531, Government Code, is
99 amended by adding Section 531.02119 to read as follows:
1010 Sec. 531.02119. DISCRIMINATION BASED ON IMMUNIZATION
1111 STATUS PROHIBITED. (a) A provider who participates in Medicaid or
1212 the child health plan program, including a provider participating
1313 in the provider network of a managed care organization that
1414 contracts with the commission to provide services under Medicaid or
1515 the child health plan program, may not refuse to provide health care
1616 services to a Medicaid recipient or child health plan program
1717 enrollee based solely on the recipient's or enrollee's refusal or
1818 failure to obtain a vaccine or immunization for a particular
1919 infectious or communicable disease.
2020 (a-1) Notwithstanding Subsection (a), a provider is not in
2121 violation of this section if the provider:
2222 (1) adopts a policy requiring some or all of the
2323 provider's patients, including patients who are Medicaid
2424 recipients or child health plan program enrollees, to be vaccinated
2525 or immunized against a particular infection or communicable disease
2626 to receive health care services from the provider; and
2727 (2) provides an exemption to the policy described by
2828 Subdivision (1) under which the provider accepts from a patient who
2929 is a Medicaid recipient or child health plan program enrollee an
3030 oral or written request for an exemption from each required
3131 vaccination or immunization based on:
3232 (A) a reason of conscience, including a sincerely
3333 held religious belief, observance, or practice, that is
3434 incompatible with the administration of the vaccination or
3535 immunization; or
3636 (B) a recognized medical condition for which the
3737 vaccination or immunization is contraindicated.
3838 (b) The commission may not provide any reimbursement under
3939 Medicaid or the child health plan program, as applicable, to a
4040 provider who violates this section unless and until the commission
4141 finds that the provider is in compliance with this section.
4242 (c) Subsection (b) applies only with respect to an
4343 individual physician. The commission may not refuse to provide
4444 reimbursement to a provider who did not violate this section based
4545 on that provider's membership in a provider group or medical
4646 organization with an individual physician who violated this
4747 section.
4848 (d) This section does not apply to a provider who is a
4949 specialist in:
5050 (1) oncology; or
5151 (2) organ transplant services.
5252 (e) The executive commissioner shall adopt rules necessary
5353 to implement this section, including rules establishing the right
5454 of a provider who is alleged to have violated this section to seek
5555 administrative and judicial review of the alleged violation.
5656 SECTION 2. If before implementing any provision of this Act
5757 a state agency determines that a waiver or authorization from a
5858 federal agency is necessary for implementation of that provision,
5959 the agency affected by the provision shall request the waiver or
6060 authorization and may delay implementing that provision until the
6161 waiver or authorization is granted.
6262 SECTION 3. This Act takes effect September 1, 2023.
