11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 61.8235(a), Education Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (a) The board, with the assistance of institutions of higher |
---|
15 | 15 | | education, career and technical education experts, and college and |
---|
16 | 16 | | career readiness experts, shall establish alignment between the |
---|
17 | 17 | | college and career readiness standards and the knowledge, skills, |
---|
18 | 18 | | and abilities students are expected to demonstrate in career and |
---|
19 | 19 | | technical education by establishing programs of study that: |
---|
20 | 20 | | (1) incorporate rigorous college and career readiness |
---|
21 | 21 | | standards, including career and technical education standards that |
---|
22 | 22 | | address both academic and technical content; |
---|
23 | 23 | | (2) support attainment of employability and career |
---|
24 | 24 | | readiness skills; |
---|
25 | 25 | | (3) progress in content specificity by beginning with |
---|
26 | 26 | | all aspects of an industry or career cluster and leading to more |
---|
27 | 27 | | occupationally specific instruction or by preparing students for |
---|
28 | 28 | | ongoing postsecondary career preparation; |
---|
29 | 29 | | (4) incorporate multiple entry and exit points with |
---|
30 | 30 | | portable demonstrations of technical or career competency, which |
---|
31 | 31 | | may include credit transfer agreements or industry-recognized |
---|
32 | 32 | | certifications; and |
---|
33 | 33 | | (5) culminate in the attainment of: |
---|
34 | 34 | | (A) an industry-recognized certification, |
---|
35 | 35 | | credential, or license; |
---|
36 | 36 | | (B) a registered apprenticeship; |
---|
37 | 37 | | (C) an apprenticeship certified by the Texas |
---|
38 | 38 | | Workforce Commission as an industry-recognized apprenticeship |
---|
39 | 39 | | program as provided by commission rule; |
---|
40 | 40 | | (D) a [or] credit-bearing postsecondary |
---|
41 | 41 | | certificate; or |
---|
42 | 42 | | (E) [(C)] an associate or baccalaureate degree. |
---|
43 | 43 | | SECTION 2. Section 133.001(1), Education Code, is amended |
---|
44 | 44 | | to read as follows: |
---|
45 | 45 | | (1) "Apprenticeship training program" means a |
---|
46 | 46 | | training program that provides on-the-job training, preparatory |
---|
47 | 47 | | instruction, supplementary instruction, or related instruction in |
---|
48 | 48 | | a trade that has been: |
---|
49 | 49 | | (A) certified as an apprenticeable occupation by |
---|
50 | 50 | | the Office of Apprenticeship; or |
---|
51 | 51 | | (B) recognized as an apprenticeable occupation |
---|
52 | 52 | | by the commission as provided by commission rule. |
---|
53 | 53 | | SECTION 3. Sections 133.002(d) and (h), Education Code, are |
---|
54 | 54 | | amended to read as follows: |
---|
55 | 55 | | (d) Each apprentice participating in a program must be given |
---|
56 | 56 | | a written apprenticeship agreement by the apprenticeship committee |
---|
57 | 57 | | stating the standards and conditions of the apprentice's employment |
---|
58 | 58 | | and training. The standards must conform substantially with the |
---|
59 | 59 | | standards of apprenticeship for the particular trade which have |
---|
60 | 60 | | been adopted by the Office of Apprenticeship or by the commission by |
---|
61 | 61 | | rule. |
---|
62 | 62 | | (h) A program must be: |
---|
63 | 63 | | (1) registered with the Office of Apprenticeship and |
---|
64 | 64 | | approved by the commission; or |
---|
65 | 65 | | (2) certified by the commission as an |
---|
66 | 66 | | industry-recognized apprenticeship program as provided by |
---|
67 | 67 | | commission rule. |
---|
68 | 68 | | SECTION 4. Chapter 133, Education Code, is amended by |
---|
69 | 69 | | adding Sections 133.0025 and 133.0065 to read as follows: |
---|
70 | 70 | | Sec. 133.0025. PRE-APPRENTICESHIPS FOR CERTAIN HIGH SCHOOL |
---|
71 | 71 | | STUDENTS. The commission by rule shall establish procedures and |
---|
72 | 72 | | standards by which the commission may allocate funds available for |
---|
73 | 73 | | the support of apprenticeship training programs under this chapter |
---|
74 | 74 | | to support pre-apprenticeships designed for high school students |
---|
75 | 75 | | enrolled in career and technical education programs of study |
---|
76 | 76 | | leading to employment in high-wage, high-demand occupations. The |
---|
77 | 77 | | standards must: |
---|
78 | 78 | | (1) be developed in coordination with the Texas |
---|
79 | 79 | | Education Agency or Texas Higher Education Coordinating Board; |
---|
80 | 80 | | (2) align with the strategic framework described by |
---|
81 | 81 | | Section 318.001, Labor Code; and |
---|
82 | 82 | | (3) ensure that any committee overseeing a |
---|
83 | 83 | | pre-apprenticeship: |
---|
84 | 84 | | (A) excludes from its membership any bargaining |
---|
85 | 85 | | agent representing apprenticeable occupations certified by the |
---|
86 | 86 | | Office of Apprenticeship; |
---|
87 | 87 | | (B) includes at least one member who is a |
---|
88 | 88 | | representative of a community-based organization that demonstrates |
---|
89 | 89 | | evidence of success in coordinating and managing job placement |
---|
90 | 90 | | services for at least one industry served by the committee; and |
---|
91 | 91 | | (C) maintains, as a majority of the committee's |
---|
92 | 92 | | membership, members who represent employers. |
---|
93 | 93 | | Sec. 133.0065. PUBLICATION OF WAGE OUTCOMES. The |
---|
94 | 94 | | commission shall publish on the commission's Internet website and |
---|
95 | 95 | | include in the unified repository for education and workforce data |
---|
96 | 96 | | developed under Section 2308A.005, Government Code, wage outcome |
---|
97 | 97 | | data for apprentices who complete an apprenticeship training |
---|
98 | 98 | | program. |
---|
99 | 99 | | SECTION 5. Section 133.007, Education Code, is amended to |
---|
100 | 100 | | read as follows: |
---|
101 | 101 | | Sec. 133.007. RULES. The commission shall adopt |
---|
102 | 102 | | [promulgate] rules necessary to implement the provisions of this |
---|
103 | 103 | | chapter, including rules establishing: |
---|
104 | 104 | | (1) which occupations are recognized by the commission |
---|
105 | 105 | | as an apprenticeable occupation, based on criteria which must |
---|
106 | 106 | | include that the occupation: |
---|
107 | 107 | | (A) be a high-wage, high-demand occupation; |
---|
108 | 108 | | (B) be customarily learned in a practical way |
---|
109 | 109 | | through a structured, systematic program of on-the-job supervised |
---|
110 | 110 | | training; |
---|
111 | 111 | | (C) be clearly identified and commonly |
---|
112 | 112 | | recognized throughout an industry; |
---|
113 | 113 | | (D) involve manual, mechanical, or technical |
---|
114 | 114 | | skills or knowledge which requires significant on-the-job work |
---|
115 | 115 | | experience; and |
---|
116 | 116 | | (E) require related instruction to supplement |
---|
117 | 117 | | the on-the-job training; |
---|
118 | 118 | | (2) standards of apprenticeship for particular |
---|
119 | 119 | | trades; and |
---|
120 | 120 | | (3) a process for and the criteria by which the |
---|
121 | 121 | | commission may certify a training or apprenticeship program as an |
---|
122 | 122 | | industry-recognized apprenticeship program, which must include: |
---|
123 | 123 | | (A) a requirement that the training or program |
---|
124 | 124 | | lead to employment in a high-wage, high-demand occupation; and |
---|
125 | 125 | | (B) criteria generally consistent with the |
---|
126 | 126 | | standards of apprenticeship as determined by the commission. |
---|
127 | 127 | | SECTION 6. As soon as practicable after the effective date |
---|
128 | 128 | | of this Act, the Texas Workforce Commission shall adopt the rules |
---|
129 | 129 | | required by Chapter 133, Education Code, as amended by this Act. |
---|
130 | 130 | | SECTION 7. This Act takes effect September 1, 2023. |
