66 AN ACT
77 relating to the establishment of a task force to make
88 recommendations for updating the livestock brand registration
99 process.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 144, Agriculture Code, is amended by
1212 adding Subchapter D to read as follows:
1313 SUBCHAPTER D. UPDATED LIVESTOCK BRAND REGISTRATION TASK FORCE
1414 Sec. 144.061. ESTABLISHMENT AND COMPOSITION OF TASK FORCE.
1515 (a) The updated livestock brand registration task force is
1616 established under this subchapter to make recommendations for
1717 updating the process of brand registration before the upcoming
1818 brand registration renewals required in 2031.
1919 (b) The Texas Animal Health Commission shall establish the
2020 task force. The task force is composed of:
2121 (1) two representatives from the County and District
2222 Clerks Association of Texas;
2323 (2) two representatives from county sheriff's
2424 departments;
2525 (3) two representatives from the Texas and
2626 Southwestern Cattle Raisers Association;
2727 (4) two representatives from the Independent
2828 Cattlemen's Association of Texas;
2929 (5) two representatives from the Texas Sheep and Goat
3030 Raisers Association;
3131 (6) two representatives from the Texas Pork Producers
3232 Association;
3333 (7) two representatives from the Texas A&M AgriLife
3434 Extension Service; and
3535 (8) two representatives from any other association or
3636 department that the Texas Animal Health Commission determines
3737 necessary.
3838 Sec. 144.062. DUTIES OF TASK FORCE. The updated livestock
3939 brand registration task force shall:
4040 (1) develop recommendations for the implementation of
4141 a digital registration method for livestock brands that:
4242 (A) is standard across all counties;
4343 (B) uses a database that will standardize the
4444 format of information for all counties; and
4545 (C) has other attributes of functionality that
4646 the task force identifies as useful;
4747 (2) develop recommendations for a technology to
4848 identify livestock that would be standardized across the state and:
4949 (A) allows the information to be read wirelessly
5050 at a distance of at least 30 feet;
5151 (B) interfaces with the statewide digital brand
5252 database;
5353 (C) is easy to implement across all producers,
5454 including large scale and small scale producers;
5555 (D) allows easy identification of the owners of
5656 estray livestock; and
5757 (E) has other attributes of functionality that
5858 the task force identifies as useful;
5959 (3) develop recommendations for updating Chapter 142,
6060 Agriculture Code, that:
6161 (A) would simplify and speed the process of
6262 reuniting estray livestock with owners;
6363 (B) reduces the operational and financial burden
6464 placed on law enforcement and political subdivisions associated
6565 with estray livestock; and
6666 (C) has other attributes of functionality that
6767 the task force identifies as useful;
6868 (4) develop recommendations for creating a digital
6969 guide of best practices for livestock owners, political
7070 subdivisions, and law enforcement agencies associated with estray
7171 livestock and livestock branding and identification; and
7272 (5) establish other goals or recommendations the task
7373 force identifies as within its scope and worth pursuing or
7474 recommending.
7575 Sec. 144.063. GIFTS. The updated livestock brand
7676 registration task force may solicit and accept gifts, grants, and
7777 donations from public and private entities to use for the purposes
7878 of this subchapter.
7979 Sec. 144.064. REPORTS. The updated livestock brand
8080 registration task force shall prepare and submit reports based on
8181 the task force's recommendations to the governor, lieutenant
8282 governor, speaker of the house of representatives, and the chairs
8383 of the relevant legislative committees. The task force shall
8484 submit:
8585 (1) a first interim report not later than December 1,
8686 2024;
8787 (2) a second interim report not later than December 1,
8888 2026;
8989 (3) a third interim report not later than December 1,
9090 2028;
9191 (4) a final interim report not later than December 1,
9292 2030; and
9393 (5) not later than December 1, 2032, a comprehensive
9494 report of the task force's analysis and findings after the
9595 implementation of the updated brand registration process following
9696 the brand renewal in 2031.
9797 Sec. 144.065. EXPIRATION. This subchapter expires January
9898 1, 2033.
9999 SECTION 2. This Act takes effect September 1, 2023.
