| 5 | 5 | | relating to qualifications for and limitations on awarding the |

| 6 | 6 | | Texas Legislative Medal of Honor. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 437.351, Government Code, is amended by |
|---|
| 9 | 9 | | amending Subsection (d) and adding Subsection (e) to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | (d) The legislature by concurrent resolution may direct the |
|---|
| 12 | 12 | | governor to award the Texas Legislative Medal of Honor to a service |
|---|
| 13 | 13 | | member nominated by the nominating committee. The committee chairs |
|---|
| 14 | 14 | | serving on the nominating committee shall jointly prepare a |
|---|
| 15 | 15 | | concurrent resolution directing the governor to award the medal to |
|---|
| 16 | 16 | | a service member nominated. The legislature may direct the medal to |
|---|
| 17 | 17 | | be awarded only during a regular session and may not, during a |
|---|
| 18 | 18 | | regular session, direct the medal to be awarded to more than: |
|---|
| 19 | 19 | | (1) one service member for service in the state or |
|---|
| 20 | 20 | | federal military forces during the period beginning after 1835 but |
|---|
| 21 | 21 | | before 1956; [and] |
|---|
| 22 | 22 | | (2) one service member for service in the state or |
|---|
| 23 | 23 | | federal military forces during the period beginning after January |
|---|
| 24 | 24 | | 1, 1956, but before September 11, 2001; and |
|---|
| 25 | 25 | | (3) one service member for service in the state or |
|---|
| 26 | 26 | | federal military forces on or after September 11, 2001 [1955]. |
|---|
| 27 | 27 | | (e) Notwithstanding Subsections (a) and (c), the Texas |
|---|
| 28 | 28 | | Legislative Medal of Honor shall be awarded to a resident of this |
|---|
| 29 | 29 | | state who receives the Congressional Medal of Honor. A Texas |
|---|
| 30 | 30 | | Legislative Medal of Honor awarded under this subsection is not |
|---|
| 31 | 31 | | included for purposes of determining the number of medals that may |
|---|
| 32 | 32 | | be awarded under Subsection (d). |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2023. |
