55 relating to qualifications for and limitations on awarding the
66 Texas Legislative Medal of Honor.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 437.351, Government Code, is amended by
99 amending Subsection (d) and adding Subsection (e) to read as
1010 follows:
1111 (d) The legislature by concurrent resolution may direct the
1212 governor to award the Texas Legislative Medal of Honor to a service
1313 member nominated by the nominating committee. The committee chairs
1414 serving on the nominating committee shall jointly prepare a
1515 concurrent resolution directing the governor to award the medal to
1616 a service member nominated. The legislature may direct the medal to
1717 be awarded only during a regular session and may not, during a
1818 regular session, direct the medal to be awarded to more than:
1919 (1) one service member for service in the state or
2020 federal military forces during the period beginning after 1835 but
2121 before 1956; [and]
2222 (2) one service member for service in the state or
2323 federal military forces during the period beginning after January
2424 1, 1956, but before September 11, 2001; and
2525 (3) one service member for service in the state or
2626 federal military forces on or after September 11, 2001 [1955].
2727 (e) Notwithstanding Subsections (a) and (c), the Texas
2828 Legislative Medal of Honor shall be awarded to a resident of this
2929 state who receives the Congressional Medal of Honor. A Texas
3030 Legislative Medal of Honor awarded under this subsection is not
3131 included for purposes of determining the number of medals that may
3232 be awarded under Subsection (d).
3333 SECTION 2. This Act takes effect September 1, 2023.
