55 AN ACT
66 relating to the delivery of alcoholic beverages from certain
77 premises to the ultimate consumer.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. SECTION 1. Section 57.02(b), Alcoholic Beverage
1010 Code, is amended to read as follows:
1111 (b) The holder of a consumer delivery permit may make
1212 deliveries of alcoholic beverages:
1313 (1) only in response to bona fide orders placed by the
1414 consumer under Section 57.01; and
1515 (2) only in an area not more than 50 miles from the
1616 retailer's premises [areas] where the sale of the beverages is
1717 legal [in:
1818 [(A) the county in which the premises of the
1919 retailer making the sale is located;
2020 [(B) the city or town in which the premises of the
2121 retailer making the sale is located, if the retailer is located in a
2222 city or town; or
2323 [(C) an area not further than two miles beyond
2424 the municipal boundary of the city or town in which the premises of
2525 the retailer is located, if applicable].
2626 SECTION 2. This Act takes effect September 1, 2023.
