| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 209.003(e), Property Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (e) The following provisions of this chapter do not apply to |
|---|
| 13 | 13 | | a property owners' association that is a mixed-use master |
|---|
| 14 | 14 | | association that existed before January 1, 1974, and that does not |
|---|
| 15 | 15 | | have the authority under a dedicatory instrument or other governing |
|---|
| 16 | 16 | | document to impose fines: |
|---|
| 17 | 17 | | (1) [Section 209.005(c); |
|---|
| 18 | 18 | | [(2)] Section 209.0056; |
|---|
| 19 | 19 | | (2) [(3)] Section 209.0057; |
|---|
| 20 | 20 | | (3) [(4)] Section 209.0058; |
|---|
| 21 | 21 | | (4) [(5)] Section 209.00592; and |
|---|
| 22 | 22 | | (5) [(6)] Section 209.0062. |

| 23 | 23 | | SECTION 2. Section 209.005, Property Code, is amended by |

| 24 | 24 | | adding Subsection (b-1) to read as follows: |

| 25 | 25 | | (b-1) This section applies to a property owners' |
|---|
| 26 | 26 | | association that is otherwise exempt from this chapter under |
|---|
| 27 | 27 | | Section 209.003(a) or (b). |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
