| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 28.0253(a)(2), Education Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (2) "Eligible institution" means an institution of |
|---|
| 13 | 13 | | higher education [that is designated as a research university or |
|---|
| 14 | 14 | | emerging research university under the coordinating board's |
|---|
| 15 | 15 | | accountability system]. |
|---|
| 16 | 16 | | SECTION 2. Section 28.0253(e), Education Code, is amended |
|---|
| 17 | 17 | | to read as follows: |
|---|
| 18 | 18 | | (e) A school district or open-enrollment charter school |
|---|
| 19 | 19 | | shall allow a student to graduate and receive [may issue] a high |
|---|
| 20 | 20 | | school diploma [to a student] under the program if, using the |
|---|
| 21 | 21 | | standards established under Subsection (c), the student |
|---|
| 22 | 22 | | demonstrates mastery of and early readiness for college in each of |
|---|
| 23 | 23 | | the subject areas described by that subsection and in a language |
|---|
| 24 | 24 | | other than English, notwithstanding any other local or state |
|---|
| 25 | 25 | | requirements. |

| 26 | 26 | | SECTION 3. Section 56.221(2), Education Code, is amended to |
|---|
| 27 | 27 | | read as follows: |
|---|
| 28 | 28 | | (2) "Eligible institution" means an institution of |
|---|
| 29 | 29 | | higher education, as that term is defined by Section 61.003[, that |
|---|
| 30 | 30 | | is designated as a research university or emerging research |
|---|
| 31 | 31 | | university under the coordinating board's accountability system]. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect September 1, 2023. |
