8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 503.001, Business & Commerce Code, is |

10 | 10 | | amended by adding Subsection (f) to read as follows: |

11 | 11 | | (f) (1) A state or local government, including a school, its |
---|
12 | 12 | | contractor, subcontractor, or agents that captures a biometric |
---|
13 | 13 | | identifier for the purpose of preventing safety or security |
---|
14 | 14 | | concerns, theft, or other illegal activity may not sell the |
---|
15 | 15 | | biometric identifier to a third-party. |
---|
16 | 16 | | (2) This section shall not be construed to prohibit a |
---|
17 | 17 | | State or local government agency, including a school, or its |
---|
18 | 18 | | contractors, subcontractors, or agents from capturing biometric |
---|
19 | 19 | | identifiers for the purpose of preventing, detecting, or responding |
---|
20 | 20 | | to safety or security incidents, theft, or other illegal activity. |

21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
