66 AN ACT
77 relating to the administration of the Texas Innovative Adult Career
88 Education (ACE) Grant Program by the Texas Higher Education
99 Coordinating Board.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 136.001, Education Code, is amended by
1212 amending Subdivision (1) and adding Subdivision (1-a) to read as
1313 follows:
1414 (1) "Coordinating board" means the Texas Higher
1515 Education Coordinating Board.
1616 (1-a) "Nonprofit organization" means an organization
1717 exempt from federal income taxation under Section 501(a), Internal
1818 Revenue Code of 1986, as an organization described by Section
1919 501(c)(3) of that code.
2020 SECTION 2. Section 136.005(a), Education Code, is amended
2121 to read as follows:
2222 (a) The coordinating board [grant administrator] shall
2323 establish and administer the Texas Innovative Adult Career
2424 Education (ACE) Grant Program to provide grants to:
2525 (1) eligible nonprofit workforce intermediary and job
2626 training organizations; and
2727 (2) eligible nonprofit organizations providing job
2828 training to veterans.
2929 SECTION 3. Section 136.006, Education Code, is amended to
3030 read as follows:
3131 Sec. 136.006. ELIGIBLE ORGANIZATIONS. (a) To be eligible
3232 for a grant under the program, a nonprofit workforce intermediary
3333 and job training organization must:
3434 (1) apply to the coordinating board [grant
3535 administrator] in the manner prescribed by the coordinating board
3636 [grant administrator];
3737 (2) provide to eligible low-income students, in
3838 partnership with public junior colleges, public state colleges, or
3939 public technical institutes:
4040 (A) job training; and
4141 (B) a continuum of services designed to move a
4242 program participant from application to employment, including
4343 outreach, assessment, case management, support services, and
4444 career placement;
4545 (3) be governed by a board or other governing
4646 structure that includes recognized leaders of broad-based
4747 community organizations and executive-level or managerial-level
4848 members of the local business community;
4949 (4) demonstrate to the satisfaction of the
5050 coordinating board [program advisory board] that the
5151 organization's program has achieved or will achieve the following
5252 measures of success among program participants:
5353 (A) above-average completion of developmental
5454 education among participating public junior college, public state
5555 college, or public technical institute students;
5656 (B) above-average persistence rates among
5757 participating public junior college, public state college, or
5858 public technical institute students;
5959 (C) above-average certificate or degree
6060 completion rates by participating students within a three-year
6161 period compared to demographically comparable public junior
6262 college, public state college, and public technical institute
6363 students; and
6464 (D) entry into careers with significantly higher
6565 earnings for program participants than previously achieved; and
6666 (5) provide matching funds in accordance with rules
6767 adopted under this chapter.
6868 (a-1) To be eligible for a grant under the program, a
6969 nonprofit organization providing job training services to veterans
7070 must:
7171 (1) apply to the coordinating board [grant
7272 administrator] in the manner prescribed by the coordinating board
7373 [grant administrator];
7474 (2) provide to veterans, in partnership with public
7575 junior colleges, public state colleges, or public technical
7676 institutes:
7777 (A) job training; and
7878 (B) a continuum of services designed to move a
7979 program participant from application to employment, including
8080 outreach, assessment, case management, support services, and
8181 career placement;
8282 (3) be governed by a board or other governing
8383 structure that includes recognized leaders of broad-based
8484 community organizations and executive-level or managerial-level
8585 members of the local business community;
8686 (4) demonstrate to the satisfaction of the
8787 coordinating board [program advisory board] that the
8888 organization's program has achieved or will achieve the following
8989 measures of success among program participants:
9090 (A) the measures prescribed by Subsections
9191 (a)(4)(A)-(C);
9292 (B) rapid attainment of civilian workforce
9393 credentials; and
9494 (C) entry into careers with significantly higher
9595 earnings for program participants than previously achieved; and
9696 (5) provide matching funds in accordance with rules
9797 adopted under this chapter.
9898 (b) The matching funds required under Subsection (a)(5) or
9999 (a-1)(5) may be obtained from any source available to the
100100 organization, including in-kind contributions, community or
101101 foundation grants, individual contributions, and local
102102 governmental agency operating funds. The coordinating board [grant
103103 administrator] may adopt rules requiring an organization to
104104 demonstrate compliance with the matching funds requirement before
105105 the payment of the next installment under an awarded grant.
106106 SECTION 4. Section 136.007, Education Code, is amended to
107107 read as follows:
108108 Sec. 136.007. RULES. [(a)] The coordinating board [grant
109109 administrator] shall adopt rules as necessary for the
110110 administration of this chapter, including [in the manner provided
111111 by Chapter 2001, Government Code, for a state agency.
112112 [(b) The grant administrator, with recommendations of the
113113 program advisory board, shall adopt] rules regarding eligibility,
114114 program tuition and fees, administrative costs, matching funds, and
115115 case management and other supports for the program. The rules may
116116 include provisions for the payment in periodic installments of
117117 grant awards.
118118 SECTION 5. The following provisions of Chapter 136,
119119 Education Code, are repealed:
120120 (1) Sections 136.002 and 136.004; and
121121 (2) Section 136.005(a-1).
122122 SECTION 6. This Act takes effect September 1, 2023.
