| 8 | 8 | | functions from the Department of Family and Protective Services to |

| 9 | 9 | | the Texas Tech University System. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 40, Human Resources Code, |
|---|
| 12 | 12 | | is amended by adding Section 40.0029 to read as follows: |
|---|
| 13 | 13 | | Sec. 40.0029. POWERS AND DUTIES RELATED TO DATA ANALYTICS |
|---|
| 14 | 14 | | AND CERTAIN REPORTS. (a) A function of the department related to |
|---|
| 15 | 15 | | analyzing data collected by the department and producing and |
|---|
| 16 | 16 | | submitting a report related to that data is transferred to the Texas |
|---|
| 17 | 17 | | Tech University System. The department shall provide the Texas |
|---|
| 18 | 18 | | Tech University System with access to the department's data and |
|---|
| 19 | 19 | | automated case tracking and information management system. |
|---|
| 20 | 20 | | (b) The department and the Texas Tech University System |
|---|
| 21 | 21 | | shall enter into a memorandum of understanding that establishes a |
|---|
| 22 | 22 | | plan for providing the university system with access to the |
|---|
| 23 | 23 | | department's data and automated case tracking and information |
|---|
| 24 | 24 | | management system used for purposes of analyzing and reporting data |
|---|
| 25 | 25 | | collected by the department to the legislature or any statewide |
|---|
| 26 | 26 | | officeholder. |
|---|
| 27 | 27 | | (c) In this code or any other law, a reference to the |
|---|
| 28 | 28 | | department in relation to analyzing data collected by the |
|---|
| 29 | 29 | | department and the submission of reports to the legislature and |
|---|
| 30 | 30 | | statewide officeholders regarding that data means the Texas Tech |
|---|
| 31 | 31 | | University System. |
|---|
| 32 | 32 | | (d) Not later than December 1, 2023, the department and the |
|---|
| 33 | 33 | | Texas Tech University System shall enter into the memorandum of |
|---|
| 34 | 34 | | understanding required by Subsection (b). This subsection expires |
|---|
| 35 | 35 | | December 1, 2024. |

| 36 | 36 | | SECTION 2. Subchapter A, Chapter 264, Family Code, is |
|---|
| 37 | 37 | | amended by adding Section 264.0171 to read as follows: |
|---|
| 38 | 38 | | Sec. 264.0171. DATA ANALYTICS AND CERTAIN REPORTS. (a) In |
|---|
| 39 | 39 | | accordance with Section 40.0029, Human Resources Code, a reference |
|---|
| 40 | 40 | | in this chapter and Chapter 265 to the department in relation to |
|---|
| 41 | 41 | | analyzing data collected by the department and producing and |
|---|
| 42 | 42 | | submitting a report related to that data means the Texas Tech |
|---|
| 43 | 43 | | University System. |
|---|
| 44 | 44 | | (b) Notwithstanding any other law, the Texas Tech |
|---|
| 45 | 45 | | University System shall analyze data collected by the department |
|---|
| 46 | 46 | | and produce and submit any reports to the legislature or statewide |
|---|
| 47 | 47 | | officeholders previously produced and submitted by the department. |
|---|
| 48 | 48 | | SECTION 3. On September 1, 2023: |
|---|
| 49 | 49 | | (1) all functions and activities related to analyzing |
|---|
| 50 | 50 | | data collected by the Department of Family and Protective Services |
|---|
| 51 | 51 | | and submitting reports to the legislature and statewide |
|---|
| 52 | 52 | | officeholders regarding that data performed by the Department of |
|---|
| 53 | 53 | | Family and Protective Services immediately before that date are |
|---|
| 54 | 54 | | transferred to the Texas Tech University System; |
|---|
| 55 | 55 | | (2) the unexpended and unobligated balance of any |
|---|
| 56 | 56 | | money appropriated by the legislature for the Department of Family |
|---|
| 57 | 57 | | and Protective Services related to analyzing data collected by the |
|---|
| 58 | 58 | | Department of Family and Protective Services and submitting reports |
|---|
| 59 | 59 | | to the legislature and statewide officeholders regarding that data |
|---|
| 60 | 60 | | is transferred to the Texas Tech University System; and |
|---|
| 61 | 61 | | (3) a reference in law or an administrative rule to the |
|---|
| 62 | 62 | | Department of Family and Protective Services related to analyzing |
|---|
| 63 | 63 | | data collected by the Department of Family and Protective Services |
|---|
| 64 | 64 | | and submitting reports to the legislature and statewide |
|---|
| 65 | 65 | | officeholders regarding that data means the Texas Tech University |
|---|
| 66 | 66 | | System. |
|---|
| 67 | 67 | | SECTION 4. This Act takes effect September 1, 2023. |
