66 AN ACT
77 relating to qualifications for participation in the moving image
88 industry incentive program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 485.023, Government Code, is amended to
1111 read as follows:
1212 Sec. 485.023. QUALIFICATION. (a) To qualify for a grant
1313 under this subchapter:
1414 (1) a production company must have spent a minimum of:
1515 (A) $250,000 in in-state spending for a film or
1616 television program; or
1717 (B) $100,000 in in-state spending for a
1818 commercial or series of commercials, an educational or
1919 instructional video or series of educational or instructional
2020 videos, or a digital interactive media production;
2121 (2) at least 25 [70] percent of the production crew,
2222 actors, and extras for a moving image project must be Texas
2323 residents unless the office determines and certifies in writing
2424 that a sufficient number of qualified crew, actors, and extras are
2525 not available to the company at the time principal photography
2626 begins;
2727 (3) at least 60 percent of the moving image project
2828 must be filmed in Texas; and
2929 (4) a production company must submit to the office an
3030 expended budget, in a format prescribed by the office, that
3131 reflects all in-state spending and includes all receipts, invoices,
3232 pay orders, and other documentation considered necessary by the
3333 office to accurately determine the amount of a production company's
3434 in-state spending that has occurred.
3535 (b) Notwithstanding Subsection (a)(2), the minimum
3636 percentage of production crew, actors, and extras required to be
3737 Texas residents increases by 10 percent after each 24-month period
3838 during which the moving image project films in this state until a
3939 maximum amount of 70 percent is reached.
4040 SECTION 2. This Act takes effect September 1, 2023.
