88 AN ACT
99 relating to design and use of a model criminal citation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1212 amended by adding Article 2.36 to read as follows:
1313 Art. 2.36. MODEL CITATION DESIGN. (a) In this article:
1414 (1) "Citation" means any summons, ticket, or other
1515 official document issued to a person by a peace officer that
1616 requires the person to respond or appear.
1717 (2) "Commission" means the Texas Commission on Law
1818 Enforcement.
1919 (3) "Law enforcement agency" means an agency of the
2020 state or an agency of a political subdivision of the state
2121 authorized by law to employ peace officers.
2222 (b) Not later than September 1 of each even-numbered year,
2323 each law enforcement agency shall adopt, implement, and, as
2424 necessary, amend the citation used by the agency. The citation
2525 implemented by the agency must conform to the model citation
2626 designed, adopted, and disseminated by the commission under this
2727 article.
2828 (c) The commission shall design, adopt, and disseminate to
2929 each law enforcement agency in this state a model citation for the
3030 purpose of:
3131 (1) reducing costs associated with the failure of a
3232 person issued a citation to appear for a scheduled court
3333 appearance; and
3434 (2) improving the efficiency of courts in this state.
3535 (d) The model citation adopted by the commission must:
3636 (1) be based on credible field, academic, or
3737 laboratory research;
3838 (2) include important information at the top of the
3939 citation;
4040 (3) be written in clear, plain language and include,
4141 as applicable:
4242 (A) the date, time, and location at which a
4343 person issued a citation must appear for court;
4444 (B) the offense charged and the action the person
4545 issued a citation is required to take regarding the charge;
4646 (C) the consequences of missing a scheduled court
4747 appearance;
4848 (D) information regarding what the person issued
4949 a citation may expect at court, including an assurance that the
5050 person will not be arrested for an unresolved misdemeanor
5151 punishable by fine only;
5252 (E) the contact information and available hours
5353 of the individual at the court who is able to provide additional
5454 information to or answer questions from the person issued a
5555 citation;
5656 (F) details for any available resources to assist
5757 with a court appearance, including resources that provide text
5858 reminders, parking details, general directions to the court,
5959 transportation options, child-care assistance, and rescheduling
6060 instructions; and
6161 (G) details for persons who are unable to afford
6262 fines or costs imposed by a court, including details for a payment
6363 plan, payment deferral, community service, and waiver or reduction
6464 of the fines or costs; and
6565 (4) include any other information, procedure, or best
6666 practice that is supported by credible research or commonly
6767 accepted as a means to achieve the purposes described by Subsection
6868 (c).
6969 (e) The commission shall consult with the following in
7070 designing the model citation:
7171 (1) the Bill Blackwood Law Enforcement Management
7272 Institute of Texas located at Sam Houston State University;
7373 (2) small, medium, and large law enforcement agencies;
7474 (3) court clerks;
7575 (4) the Office of Court Administration of the Texas
7676 Judicial System;
7777 (5) judges;
7878 (6) public defenders; and
7979 (7) prosecutors.
8080 (f) The commission shall provide for a period of public
8181 comment before adopting the model citation design.
8282 (g) Not later than December 31 of each odd-numbered year,
8383 the commission shall:
8484 (1) review the model citation adopted under this
8585 article;
8686 (2) if appropriate, modify or update the design; and
8787 (3) disseminate the design to each law enforcement
8888 agency in this state.
8989 SECTION 2. (a) Not later than December 31, 2023, the Texas
9090 Commission on Law Enforcement shall design, adopt, and disseminate
9191 the model citation required under Article 2.36, Code of Criminal
9292 Procedure, as added by this Act.
9393 (b) Not later than September 1, 2024, each law enforcement
9494 agency to which Article 2.36, Code of Criminal Procedure, as added
9595 by this Act, applies shall adopt a citation as required by that
9696 article.
9797 SECTION 3. This Act takes effect September 1, 2023.
