| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter B, Chapter 264, Family Code, is |

| 10 | 10 | | amended by adding Section 264.105 to read as follows: |

| 11 | 11 | | Sec. 264.105. PROHIBITED DISCRIMINATION IN FOSTER CARE. |
|---|
| 12 | 12 | | (a) Notwithstanding Section 264.0011, in this section, |
|---|
| 13 | 13 | | "commission" means the Health and Human Services Commission. |
|---|
| 14 | 14 | | (b) The commission, the department, a single source |
|---|
| 15 | 15 | | continuum contractor, and any other person may not discriminate or |
|---|
| 16 | 16 | | take any adverse action against a person on the basis of the |
|---|
| 17 | 17 | | person's sexual orientation, gender identity, or gender expression |
|---|
| 18 | 18 | | relating to child welfare services, including the licensure or |
|---|
| 19 | 19 | | verification of a foster home or the placement of a child. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect September 1, 2023. |
