55 AN ACT
66 Relating to educational benefits for eligible persons attending a
77 comprehensive transition and postsecondary program for students
88 with intellectual disabilities
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section Sec. 54.001, Education Code, is amended
1111 by adding subsection (3)to read as follows:
1212 Sec. 54.001. DEFINITIONS. In this chapter:
1313 (1) "Institution of higher education" has the same
1414 meaning as is assigned to it by Section 61.003 of this code.
1515 (2) "Governing board" has the same meaning as is
1616 assigned to it by Section 61.003 of this code.
1717 (3) "COMPREHENSIVE TRANSITION AND POSTSECONDARY
1818 PROGRAM FOR STUDENTS WITH INTELLECTUAL DISABILITIES" has the same
1919 meaning as in 20 U.S.C. ยง 1140.
2020 SECTION 2. Sec. 54.341(1), Education Code, is amended to
2121 read as follows:
2222 Sec. 54.341. VETERANS AND OTHER MILITARY PERSONNEL;
2323 DEPENDENTS; and STUDENTS WHO IS ADMITTED TO ATTEND AND ATTENDS A
2424 COMPREHENSIVE TRANSITION AND POSTSECONDARY PROGRAM FOR STUDENTS
2525 WITH INTELLECTUAL DISABILITIES.
2626 (l) To be eligible to receive an exemption under Subsection
2727 (k), the child must:
2828 (1) be a student who is classified as a resident under
2929 Subchapter B when the child enrolls in an institution of higher
3030 education;
3131 (2) as a graduate or undergraduate student, maintain a
3232 grade point average that satisfies the grade point average
3333 requirement for making satisfactory academic progress in a degree,
3434 certificate, or continuing education program as determined by the
3535 institution at which the child is enrolled in accordance with the
3636 institution's policy regarding eligibility for financial aid; or
3737 any student who is admitted to attend and attends a comprehensive
3838 transition and postsecondary program for students with
3939 intellectual disabilities;
4040 (3) be 25 years of age or younger on the first day of
4141 the semester or other academic term for which the exemption is
4242 claimed.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2023.
