66 AN ACT
77 relating to the authority of a county commissioner to employ and
88 commission a peace officer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 81, Local Government Code,
1111 is amended by adding Section 81.035 to read as follows:
1212 Sec. 81.035. PEACE OFFICERS. A county commissioner may
1313 employ and commission as a peace officer a person who has been
1414 certified as qualified to be a peace officer by the Texas Commission
1515 on Law Enforcement.
1616 SECTION 2. Article 2.12, Code of Criminal Procedure, is
1717 amended to read as follows:
1818 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1919 officers:
2020 (1) sheriffs, their deputies, and those reserve
2121 deputies who hold a permanent peace officer license issued under
2222 Chapter 1701, Occupations Code;
2323 (2) constables, deputy constables, and those reserve
2424 deputy constables who hold a permanent peace officer license issued
2525 under Chapter 1701, Occupations Code;
2626 (3) marshals or police officers of an incorporated
2727 city, town, or village, and those reserve municipal police officers
2828 who hold a permanent peace officer license issued under Chapter
2929 1701, Occupations Code;
3030 (4) rangers, officers, and members of the reserve
3131 officer corps commissioned by the Public Safety Commission and the
3232 Director of the Department of Public Safety;
3333 (5) investigators of the district attorneys', criminal
3434 district attorneys', and county attorneys' offices;
3535 (6) law enforcement agents of the Texas Alcoholic
3636 Beverage Commission;
3737 (7) each member of an arson investigating unit
3838 commissioned by a city, a county, or the state;
3939 (8) officers commissioned under Section 37.081,
4040 Education Code, or Subchapter E, Chapter 51, Education Code;
4141 (9) officers commissioned by the General Services
4242 Commission;
4343 (10) law enforcement officers commissioned by the
4444 Parks and Wildlife Commission;
4545 (11) officers commissioned under Chapter 23,
4646 Transportation Code;
4747 (12) municipal park and recreational patrolmen and
4848 security officers;
4949 (13) security officers and investigators commissioned
5050 as peace officers by the comptroller;
5151 (14) officers commissioned by a water control and
5252 improvement district under Section 49.216, Water Code;
5353 (15) officers commissioned by a board of trustees
5454 under Chapter 54, Transportation Code;
5555 (16) investigators commissioned by the Texas Medical
5656 Board;
5757 (17) officers commissioned by:
5858 (A) the board of managers of the Dallas County
5959 Hospital District, the Tarrant County Hospital District, the Bexar
6060 County Hospital District, or the El Paso County Hospital District
6161 under Section 281.057, Health and Safety Code;
6262 (B) the board of directors of the Ector County
6363 Hospital District under Section 1024.117, Special District Local
6464 Laws Code;
6565 (C) the board of directors of the Midland County
6666 Hospital District of Midland County, Texas, under Section 1061.121,
6767 Special District Local Laws Code; and
6868 (D) the board of hospital managers of the Lubbock
6969 County Hospital District of Lubbock County, Texas, under Section
7070 1053.113, Special District Local Laws Code;
7171 (18) county park rangers commissioned under
7272 Subchapter E, Chapter 351, Local Government Code;
7373 (19) investigators employed by the Texas Racing
7474 Commission;
7575 (20) officers commissioned under Chapter 554,
7676 Occupations Code;
7777 (21) officers commissioned by the governing body of a
7878 metropolitan rapid transit authority under Section 451.108,
7979 Transportation Code, or by a regional transportation authority
8080 under Section 452.110, Transportation Code;
8181 (22) investigators commissioned by the attorney
8282 general under Section 402.009, Government Code;
8383 (23) security officers and investigators commissioned
8484 as peace officers under Chapter 466, Government Code;
8585 (24) officers appointed by an appellate court under
8686 Subchapter F, Chapter 53, Government Code;
8787 (25) officers commissioned by the state fire marshal
8888 under Chapter 417, Government Code;
8989 (26) an investigator commissioned by the commissioner
9090 of insurance under Section 701.104, Insurance Code;
9191 (27) apprehension specialists and inspectors general
9292 commissioned by the Texas Juvenile Justice Department as officers
9393 under Sections 242.102 and 243.052, Human Resources Code;
9494 (28) officers appointed by the inspector general of
9595 the Texas Department of Criminal Justice under Section 493.019,
9696 Government Code;
9797 (29) investigators commissioned by the Texas
9898 Commission on Law Enforcement under Section 1701.160, Occupations
9999 Code;
100100 (30) commission investigators commissioned by the
101101 Texas Private Security Board under Section 1702.061, Occupations
102102 Code;
103103 (31) the fire marshal and any officers, inspectors, or
104104 investigators commissioned by an emergency services district under
105105 Chapter 775, Health and Safety Code;
106106 (32) officers commissioned by the State Board of
107107 Dental Examiners under Section 254.013, Occupations Code, subject
108108 to the limitations imposed by that section;
109109 (33) investigators commissioned by the Texas Juvenile
110110 Justice Department as officers under Section 221.011, Human
111111 Resources Code; [and]
112112 (34) the fire marshal and any related officers,
113113 inspectors, or investigators commissioned by a county under
114114 Subchapter B, Chapter 352, Local Government Code; and
115115 (35) officers commissioned by a county commissioner
116116 under Section 81.035, Local Government Code.
117117 SECTION 3. This Act takes effect September 1, 2023.
