5	5	relating to reporting of certain information by state agencies and
6	6	counties, including information related to appropriated money,
7	7	activities of certain consultants, and tax revenue.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 2101.011, Government Code, is amended by
10	10	amending Subsections (a) and (b) and adding Subsections (b-1) and
11	11	(b-2) to read as follows:
12	12	(a) In this section:
13	13	(1) "Annual financial report" means the annual
14	14	financial report required by this section.
15	15	(2) "Appropriated money" means money appropriated by
16	16	the legislature under the General Appropriations Act or other law.
17	17	(3) "Institution of higher education" has the meaning
18	18	assigned by Section 61.003, Education Code.
19	19	(b) Except as provided by Subsections (b-1) and (b-2), not
20	20	[Not] later than November 1 [20] of each year, a state agency shall
21	21	submit an annual financial report regarding the agency's use of
22	22	appropriated money during the preceding fiscal year to:
23	23	(1) the governor;
24	24	(2) the comptroller;
25	25	(3) the Legislative Reference Library;
26	26	(4) the state auditor; and
27	27	(5) the Legislative Budget Board.
28	28	(b-1) An institution of higher education shall submit the
29	29	annual financial report described by Subsection (b) not later than
30	30	November 20 of each year.
31	31	(b-2) A state agency may submit an audited financial report
32	32	in place of the report described by Subsection (b). An audited
33	33	financial report must be submitted not later than December 15 of
34	34	each year.
35	35	SECTION 2. Section 2115.005, Government Code, is amended to
36	36	read as follows:
37	37	Sec. 2115.005. ANNUAL REPORT BY COMPTROLLER [FORWARDING
38	38	REPORTS]. (a) Subject to Subsection (b), not [The comptroller
39	39	shall provide copies, including electronic form copies, of any
40	40	reports received from a consultant contracting under Section
41	41	2115.002 to:
42	42	[(1) the governor;
43	43	[(2) the state auditor's office; and
44	44	[(3) the Legislative Budget Board.
45	45	[(b) The comptroller shall provide the copies required by
46	46	Subsection (a) not later than the 15th day after the date the
47	47	comptroller receives the consultant's report.
48	48	[(c) Not] later than February 1 of each [odd-numbered] year,
49	49	the comptroller shall issue [a report] to the legislature,
50	50	governor, state auditor's office, and Legislative Budget Board a
51	51	report summarizing the activities conducted by a consultant
52	52	pursuant to a recovery audit completed under this chapter during
53	53	the preceding state fiscal [biennium ending August 31 of the
54	54	previous] year.
55	55	(b) The comptroller is required to issue a report under
56	56	Subsection (a) only if a recovery audit was completed under this
57	57	chapter during the preceding state fiscal year.
58	58	SECTION 3. Section 61.040, Health and Safety Code, is
59	59	amended to read as follows:
60	60	Sec. 61.040. TAX INFORMATION. (a) For the purpose of
61	61	determining eligibility for state assistance under this chapter,
62	62	[The comptroller shall give] the department may require a county to
63	63	provide the following information for the relevant period [relating
64	64	to]:
65	65	(1) the taxable value of property taxable by the
66	66	[each] county;
67	67	(2) the [and each] county's applicable general revenue
