55 relating to reporting of certain information by state agencies and
66 counties, including information related to appropriated money,
77 activities of certain consultants, and tax revenue.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2101.011, Government Code, is amended by
1010 amending Subsections (a) and (b) and adding Subsections (b-1) and
1111 (b-2) to read as follows:
1212 (a) In this section:
1313 (1) "Annual financial report" means the annual
1414 financial report required by this section.
1515 (2) "Appropriated money" means money appropriated by
1616 the legislature under the General Appropriations Act or other law.
1717 (3) "Institution of higher education" has the meaning
1818 assigned by Section 61.003, Education Code.
1919 (b) Except as provided by Subsections (b-1) and (b-2), not
2020 [Not] later than November 1 [20] of each year, a state agency shall
2121 submit an annual financial report regarding the agency's use of
2222 appropriated money during the preceding fiscal year to:
2323 (1) the governor;
2424 (2) the comptroller;
2525 (3) the Legislative Reference Library;
2626 (4) the state auditor; and
2727 (5) the Legislative Budget Board.
2828 (b-1) An institution of higher education shall submit the
2929 annual financial report described by Subsection (b) not later than
3030 November 20 of each year.
3131 (b-2) A state agency may submit an audited financial report
3232 in place of the report described by Subsection (b). An audited
3333 financial report must be submitted not later than December 15 of
3434 each year.
3535 SECTION 2. Section 2115.005, Government Code, is amended to
3636 read as follows:
3737 Sec. 2115.005. ANNUAL REPORT BY COMPTROLLER [FORWARDING
3838 REPORTS]. (a) Subject to Subsection (b), not [The comptroller
3939 shall provide copies, including electronic form copies, of any
4040 reports received from a consultant contracting under Section
4141 2115.002 to:
4242 [(1) the governor;
4343 [(2) the state auditor's office; and
4444 [(3) the Legislative Budget Board.
4545 [(b) The comptroller shall provide the copies required by
4646 Subsection (a) not later than the 15th day after the date the
4747 comptroller receives the consultant's report.
4848 [(c) Not] later than February 1 of each [odd-numbered] year,
4949 the comptroller shall issue [a report] to the legislature,
5050 governor, state auditor's office, and Legislative Budget Board a
5151 report summarizing the activities conducted by a consultant
5252 pursuant to a recovery audit completed under this chapter during
5353 the preceding state fiscal [biennium ending August 31 of the
5454 previous] year.
5555 (b) The comptroller is required to issue a report under
5656 Subsection (a) only if a recovery audit was completed under this
5757 chapter during the preceding state fiscal year.
5858 SECTION 3. Section 61.040, Health and Safety Code, is
5959 amended to read as follows:
6060 Sec. 61.040. TAX INFORMATION. (a) For the purpose of
6161 determining eligibility for state assistance under this chapter,
6262 [The comptroller shall give] the department may require a county to
6363 provide the following information for the relevant period [relating
6464 to]:
6565 (1) the taxable value of property taxable by the
6666 [each] county;
6767 (2) the [and each] county's applicable general revenue
6868 tax levy [for the relevant period]; and
6969 (3) [(2)] the amount of sales and use tax revenue
7070 received by the [each] county [for the relevant period].
7171 (b) The department shall prescribe the manner in which a
7272 county must provide the information described by Subsection (a).
7373 SECTION 4. This Act takes effect September 1, 2024.
