5	5	AN ACT
6	6	relating to the authority of certain municipalities to receive
7	7	certain tax revenue derived from a hotel and convention center
8	8	project and to pledge certain tax revenue for the payment of
9	9	obligations related to the project.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 351.152, Tax Code, is amended to read as
12	12	follows:
13	13	Sec. 351.152. APPLICABILITY. This subchapter applies only
14	14	to:
15	15	(1) a municipality described by Section
16	16	351.001(7)(B);
17	17	(2) a municipality described by Section
18	18	351.001(7)(D);
19	19	(3) a municipality described by Section
20	20	351.001(7)(E);
21	21	(4) a municipality described by Section
22	22	351.102(e)(3);
23	23	(5) a municipality that contains more than 75 percent
24	24	of the population of a county with a population of 1.5 million or
25	25	more;
26	26	(6) a municipality with a population of 150,000 or
27	27	more but less than 200,000 that is partially located in at least one
28	28	county with a population of 125,000 or more;
29	29	(7) a municipality with a population of 150,000 or
30	30	more but less than one million that is located in one county with a
31	31	population of 2.3 million or more;
32	32	(8) a municipality with a population of 180,000 or
33	33	more that:
34	34	(A) is located in two counties, each with a
35	35	population of 100,000 or more; and
36	36	(B) contains an American Quarter Horse Hall of
37	37	Fame and Museum;
38	38	(9) a municipality with a population of 96,000 or more
39	39	that is located in a county that borders Lake Palestine;
40	40	(10) a municipality with a population of 96,000 or
41	41	more that is located in a county that contains the headwaters of the
42	42	San Gabriel River;
43	43	(11) a municipality with a population of 99,900 or
44	44	more but less than 111,000 that is located in a county with a
45	45	population of 135,000 or more;
46	46	(12) a municipality with a population of 110,000 or
47	47	more but less than 135,000 at least part of which is located in a
48	48	county with a population of less than 135,000;
49	49	(13) a municipality with a population of 9,000 or more
50	50	but less than 10,000 that is located in two counties, each of which
51	51	has a population of 662,000 or more and a southern border with a
52	52	county with a population of 2.3 million or more;
53	53	(14) a municipality with a population of 200,000 or
54	54	more but less than 300,000 that contains a component institution of
55	55	the Texas Tech University System;
56	56	(15) a municipality with a population of 95,000 or
57	57	more that:
58	58	(A) is located in more than one county; and
59	59	(B) borders Lake Lewisville;
60	60	(16) a municipality with a population of 45,000 or
61	61	more that:
62	62	(A) contains a portion of Cedar Hill State Park;
63	63	(B) is located in two counties, one of which has a
64	64	population of two million or more and one of which has a population
65	65	of 149,000 or more; and
66	66	(C) has adopted a capital improvement plan for
67	67	the construction or expansion of a convention center facility;
68	68	(17) a municipality with a population of less than
69	69	6,000 that:
70	70	(A) is almost wholly located in a county with a
71	71	population of 600,000 or more that is adjacent to a county with a
72	72	population of two million or more;
73	73	(B) is partially located in a county with a
74	74	population of 1.8 million or more that is adjacent to a county with
75	75	a population of two million or more;
76	76	(C) has a visitor center and museum located in a
77	77	19th-century rock building in the municipality's downtown; and
78	78	(D) has a waterpark open to the public;
79	79	(18) a municipality with a population of 56,000 or
80	80	more that:
81	81	(A) borders Lake Ray Hubbard; and
82	82	(B) is located in two counties, one of which has a
83	83	population of less than 80,000;
84	84	(19) a municipality with a population of 83,000 or
85	85	more that:
86	86	(A) borders Clear Lake; and
87	87	(B) is primarily located in a county with a
88	88	population of less than 300,000;
89	89	(20) a municipality with a population of less than
90	90	2,000 that:
91	91	(A) is located adjacent to a bay connected to the
92	92	Gulf of Mexico;
93	93	(B) is located in a county with a population of
94	94	290,000 or more that is adjacent to a county with a population of
95	95	four million or more; and
96	96	(C) has a boardwalk on the bay;
97	97	(21) a municipality with a population of 75,000 or
98	98	more that:
99	99	(A) is located wholly in one county with a
100	100	population of 575,000 or more that is adjacent to a county with a
101	101	population of four million or more; and
102	102	(B) has adopted a capital improvement plan for
103	103	the construction or expansion of a convention center facility;
104	104	(22) a municipality with a population of less than
105	105	75,000 that is located in three counties, at least one of which has
106	106	a population of four million or more;
107	107	(23) an eligible coastal municipality with a
108	108	population of 3,000 or more but less than 5,000;
109	109	(24) a municipality with a population of 90,000 or
110	110	more but less than 150,000 that:
111	111	(A) is located in three counties; and
112	112	(B) contains a branch campus of a component
113	113	institution of the University of Houston System;
114	114	(25) a municipality that is:
115	115	(A) primarily located in a county with a
116	116	population of four million or more; and
117	117	(B) connected by a bridge to a municipality
118	118	described by Subdivision (20);
119	119	(26) a municipality with a population of 20,000 or
120	120	more but less than 25,000 that:
121	121	(B) contains a portion of Mustang Bayou; and
122	122	(C) is wholly located in a county with a
123	123	population of less than 500,000;
124	124	(27) a municipality with a population of 70,000 or
125	125	more but less than 90,000 that is located in two counties, one of
126	126	which has a population of four million or more and the other of
127	127	which has a population of less than 50,000;
128	128	(28) a municipality with a population of 10,000 or
129	129	more that:
130	130	(A) is wholly located in a county with a
131	131	population of four million or more; and
132	132	(B) has a city hall located less than three miles
133	133	from a space center operated by an agency of the federal government;
134	134	(29) a municipality that is the county seat of a
135	135	county:
136	136	(A) through which the Pedernales River flows; and
137	137	(B) in which the birthplace of a president of the
138	138	United States is located;
139	139	(30) a municipality that contains a portion of U.S.
140	140	Highway 79 and State Highway 130;
141	141	(31) a municipality with a population of 48,000 or
142	142	more but less than 95,000 that is located in two counties, one of
143	143	which has a population of 900,000 or more but less than 1.7 million;
144	144	(32) a municipality with a population of less than
145	145	25,000 that contains a museum of Western American art;
146	146	(33) a municipality with a population of 50,000 or
147	147	more that is the county seat of a county that contains a portion of
148	148	the Sam Houston National Forest;
149	149	(34) a municipality with a population of less than
150	150	25,000 that:
151	151	(A) contains a cultural heritage museum; and
152	152	(B) is located in a county that borders the
153	153	United Mexican States and the Gulf of Mexico;
154	154	(35) a municipality that is the county seat of a county
155	155	that:
156	156	(A) has a population of 115,000 or more;
157	157	(B) is adjacent to a county with a population of
158	158	1.8 million or more; and
159	159	(C) hosts an annual peach festival;
160	160	(36) a municipality that is the county seat of a county
161	161	that:
162	162	(A) has a population of 585,000 or more; and
163	163	(B) is adjacent to a county with a population of
164	164	four million or more;
165	165	(37) a municipality with a population of less than
166	166	10,000 that:
167	167	(A) contains a component university of The Texas
168	168	A&M University System; and
169	169	(B) is located in a county adjacent to a county
170	170	that borders Oklahoma;
171	171	(38) a municipality with a population of less than
172	172	6,100 that:
173	173	(A) is located in two counties, each of which has
174	174	a population of 600,000 or more but less than two million; and
175	175	(B) hosts an annual Cajun Festival;
176	176	(39) a municipality with a population of 13,000 or
177	177	more that:
178	178	(A) is located on an international border; and
179	179	(B) is located in a county:
180	180	(i) with a population of less than 400,000;
181	181	and
182	182	(ii) in which at least one World Birding
183	183	Center site is located;
184	184	(40) a municipality with a population of 4,000 or more
185	185	that:
186	186	(A) is located on an international border; and
187	187	(B) is located not more than five miles from a
188	188	state historic site that serves as a visitor center for a state park
189	189	that contains 300,000 or more acres of land;
190	190	(41) a municipality with a population of 36,000 or
191	191	more that is adjacent to at least two municipalities described by
192	192	Subdivision (15);
193	193	(42) a municipality with a population of 28,000 or
194	194	more that is located in a county with a population of 240,000 or
195	195	more in which is located a portion of the Balcones River and a
196	196	historic railroad depot and heritage center;
197	197	(43) a municipality located in a county that has a
198	198	population of not more than 300,000 and in which a component
199	199	university of the University of Houston System is located;
200	200	(44) a municipality with a population of less than
201	201	500,000 that is:
202	202	(A) located in two counties; and
203	203	(B) adjacent to a municipality described by
204	204	Subdivision (31); [and]
205	205	(45) a municipality that:
206	206	(A) has a population of more than 67,000; and
207	207	(B) is located in two counties with 90 percent of
208	208	the municipality's territory located in a county with a population
209	209	of at least 580,000, and the remaining territory located in a county
210	210	with a population of at least four million; and
211	211	(46) a municipality that:
212	212	(A) has a historical commercial district
213	213	designated on the National Register of Historic Places and hosts an
214	214	annual Grapefest event;
215	215	(B) has a population of 50,000 or more; and
216	216	(C) is partially located in three counties all of
217	217	which have a population of 900,000 or more.
218	218	SECTION 2. This Act takes effect September 1, 2023.
