| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 43.031, Election Code, is amended by | |
| 10 | 10 | adding Subsection (f) to read as follows: | |
| 11 | 11 | (f) If the entity that owns or controls a public building | |
| 12 | 12 | selected for a polling place under this section is a school district | |
| 13 | 13 | and fails to make the building available in accordance with | |
| 14 | 14 | Subsection (c), the district may not designate the building as a | |
| 15 | 15 | polling place for an election for the board of trustees or for a | |
| 16 | 16 | school district bond election until after the fifth anniversary of | |
| 17 | 17 | the date of the election in which the district failed to comply with | |
| 18 | 18 | this section. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2023. |
