55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to instruction in human trafficking awareness in public
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.002, Education Code, is amended by
1111 amending Subsection (a) and adding Subsections (u) and (u-1) to
1212 read as follows:
1313 (a) Each school district that offers kindergarten through
1414 grade 12 shall offer, as a required curriculum:
1515 (1) a foundation curriculum that includes:
1616 (A) English language arts;
1717 (B) mathematics;
1818 (C) science; and
1919 (D) social studies, consisting of Texas, United
2020 States, and world history, government, economics, with emphasis on
2121 the free enterprise system and its benefits, and geography; and
2222 (2) an enrichment curriculum that includes:
2323 (A) to the extent possible, languages other than
2424 English;
2525 (B) health, with emphasis on:
2626 (i) physical health, including the
2727 importance of proper nutrition and exercise;
2828 (ii) mental health, including instruction
2929 about mental health conditions, substance abuse, skills to manage
3030 emotions, establishing and maintaining positive relationships, and
3131 responsible decision-making; and
3232 (iii) suicide prevention, including
3333 recognizing suicide-related risk factors and warning signs;
3434 (C) physical education;
3535 (D) fine arts;
3636 (E) career and technology education;
3737 (F) technology applications;
3838 (G) religious literature, including the Hebrew
3939 Scriptures (Old Testament) and New Testament, and its impact on
4040 history and literature; [and]
4141 (H) personal financial literacy; and
4242 (I) human trafficking awareness.
4343 (u) In adopting the essential knowledge and skills for the
4444 human trafficking awareness curriculum required under Subsection
4545 (a)(2)(I), the State Board of Education shall ensure that the
4646 curriculum includes grade-level appropriate instruction relating
4747 to:
4848 (1) for students in grades six through eight:
4949 (A) the underlying causes of human trafficking;
5050 (B) identification of and prevention of human
5151 trafficking for labor and sexual exploitation, with an emphasis on:
5252 (i) understanding the signs or indicators
5353 of human trafficking;
5454 (ii) practicing online safety; and
5555 (iii) understanding the methods used by
5656 human traffickers to recruit children;
5757 (C) methods for reporting suspected human
5858 trafficking; and
5959 (D) interventions and treatment provided to
6060 survivors of human trafficking; and
6161 (2) for students in grades 9 through 12, the topics
6262 provided by Subdivision (1) and:
6363 (A) the commercial sexual exploitation of and
6464 vulnerability to human trafficking of minors;
6565 (B) the role of gender in the selection of
6666 targets for human trafficking;
6767 (C) distinguishing human trafficking from other
6868 types of offenses involving the transport or movement of
6969 individuals by others, such as kidnapping and human smuggling; and
7070 (D) domestic and foreign policy responses to
7171 human trafficking.
7272 (u-1) The State Board of Education shall adopt rules
7373 requiring students enrolled in grades six through eight to complete
7474 a one-semester human trafficking awareness course covering the
7575 essential knowledge and skills described by Subsection (u)(1). The
7676 course may be required only once for the middle school grade levels.
7777 SECTION 2. Section 28.025(b-1), Education Code, is amended
7878 to read as follows:
7979 (b-1) The State Board of Education by rule shall require
8080 that the curriculum requirements for the foundation high school
8181 program under Subsection (a) include a requirement that students
8282 successfully complete:
8383 (1) four credits in English language arts under
8484 Section 28.002(a)(1)(A), including one credit in English I, one
8585 credit in English II, one credit in English III, and one credit in
8686 an advanced English course authorized under Subsection (b-2);
8787 (2) three credits in mathematics under Section
8888 28.002(a)(1)(B), including one credit in Algebra I, one credit in
8989 geometry, and one credit in any advanced mathematics course
9090 authorized under Subsection (b-2);
9191 (3) three credits in science under Section
9292 28.002(a)(1)(C), including one credit in biology, one credit in any
9393 advanced science course authorized under Subsection (b-2), and one
9494 credit in integrated physics and chemistry or in an additional
9595 advanced science course authorized under Subsection (b-2);
9696 (4) three credits in social studies under Section
9797 28.002(a)(1)(D), including one credit in United States history, at
9898 least one-half credit in government and at least one-half credit in
9999 economics or personal financial literacy & economics, and one
100100 credit in world geography or world history;
101101 (5) except as provided under Subsections (b-12),
102102 (b-13), and (b-14), two credits in the same language in a language
103103 other than English under Section 28.002(a)(2)(A);
104104 (6) four and one-half [five] elective credits;
105105 (7) one credit in fine arts under Section
106106 28.002(a)(2)(D); [and]
107107 (8) except as provided by Subsection (b-11), one
108108 credit in physical education under Section 28.002(a)(2)(C); and
109109 (9) one-half credit in human trafficking awareness
110110 under Section 28.002(a)(2)(I).
111111 SECTION 3. As soon as practicable after the effective date
112112 of this Act, the State Board of Education shall develop the
113113 curriculum required under Section 28.002(u), Education Code, as
114114 added by this Act.
115115 SECTION 4. (a) Sections 28.002(u)(1) and (u-1), Education
116116 Code, as added by this Act, apply only to the middle school
117117 curriculum required for students entering the sixth grade during
118118 the 2023-2024 school year or a later school year.
119119 (b) Section 28.025(b-1), Education Code, as amended by this
120120 Act, applies only to students entering the ninth grade during the
121121 2023-2024 school year or a later school year. For students entering
122122 a grade above ninth grade during the 2023-2024 school year, Section
123123 28.025(b-1), Education Code, as that section existed before
124124 amendment by this Act, applies, and that section is continued in
125125 effect for that purpose.
126126 SECTION 5. This Act takes effect immediately if it receives
127127 a vote of two-thirds of all the members elected to each house, as
128128 provided by Section 39, Article III, Texas Constitution. If this
129129 Act does not receive the vote necessary for immediate effect, this
130130 Act takes effect September 1, 2023.
