7 | 7 | | relating to the definition of subdivision golf course for purposes |

8 | 8 | | of certain municipal platting requirements. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 212.0155(b)(5), Local Government Code, |
---|
11 | 11 | | is amended to read as follows: |
---|
12 | 12 | | (5) "Subdivision golf course" means an area of land: |
---|
13 | 13 | | (A) that was originally developed as a golf |
---|
14 | 14 | | course or a country club within a common scheme of development for a |
---|
15 | 15 | | predominantly residential single-family development project; |
---|
16 | 16 | | (B) that [was] at any time in the 12 [seven] years |
---|
17 | 17 | | preceding the date on which a new plat for the land is filed: |
---|
18 | 18 | | (i) was used as a golf course or a country |
---|
19 | 19 | | club; |
---|
20 | 20 | | (ii) was zoned as a community facility; |
---|
21 | 21 | | (iii) benefited from restrictive covenants |
---|
22 | 22 | | on adjoining homeowners; or |
---|
23 | 23 | | (iv) was designated on a recorded plat as a |
---|
24 | 24 | | golf course or a country club; and |
---|
25 | 25 | | (C) that is not separated entirely from the |
---|
26 | 26 | | predominantly residential single-family development project by a |
---|
27 | 27 | | public street. |
---|
28 | 28 | | SECTION 2. The change in law made by this Act applies only |
---|
29 | 29 | | to a plat filed on or after the effective date of this Act. A plat |
---|
30 | 30 | | filed before the effective date of this Act is governed by the law |
---|
31 | 31 | | in effect on the date the plat was filed, and that law is continued |
---|
32 | 32 | | in effect for that purpose. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2023. |
---|
