55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of subdivision golf course for purposes
88 of certain municipal platting requirements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 212.0155(b)(5), Local Government Code,
1111 is amended to read as follows:
1212 (5) "Subdivision golf course" means an area of land:
1313 (A) that was originally developed as a golf
1414 course or a country club within a common scheme of development for a
1515 predominantly residential single-family development project;
1616 (B) that [was] at any time in the 12 [seven] years
1717 preceding the date on which a new plat for the land is filed:
1818 (i) was used as a golf course or a country
1919 club;
2020 (ii) was zoned as a community facility;
2121 (iii) benefited from restrictive covenants
2222 on adjoining homeowners; or
2323 (iv) was designated on a recorded plat as a
2424 golf course or a country club; and
2525 (C) that is not separated entirely from the
2626 predominantly residential single-family development project by a
2727 public street.
2828 SECTION 2. The change in law made by this Act applies only
2929 to a plat filed on or after the effective date of this Act. A plat
3030 filed before the effective date of this Act is governed by the law
3131 in effect on the date the plat was filed, and that law is continued
3232 in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2023.
