66 AN ACT
77 relating to the renewal and review of certain air quality permits.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 382.05195(e), (f), and (k), Health and
1010 Safety Code, are amended to read as follows:
1111 (e) The commission by rule shall establish procedures for
1212 the amendment of a standard permit and for an application for, the
1313 issuance of, the renewal of, and the revocation of an authorization
1414 to use a standard permit. The commission shall evaluate the
1515 protectiveness of each standard permit issued under this section at
1616 least once every six years. Each authorization to use a standard
1717 permit issued under this section is subject to review at least once
1818 every six years to determine whether the authority to operate
1919 should be renewed.
2020 (f) The commission shall require a [A] facility authorized
2121 to emit air contaminants under a standard permit to [shall] comply
2222 with an amendment to the standard permit beginning on a [the] date
2323 that is not later than the date the facility's authorization to use
2424 the standard permit is renewed [or the date the commission
2525 otherwise provides]. Before the date the facility is required to
2626 comply with the amendment, the standard permit, as it read before
2727 the amendment, applies to the facility.
2828 (k) An application for an authorization to use [the issuance
2929 of] a standard permit under this section for a concrete plant that
3030 performs wet batching, dry batching, or central mixing, including a
3131 permanent, temporary, or specialty concrete batch plant, as defined
3232 by the commission, must include a plot plan that clearly shows:
3333 (1) a distance scale;
3434 (2) a north arrow;
3535 (3) all property lines, emission points, buildings,
3636 tanks, and process vessels and other process equipment in the area
3737 in which the facility will be located;
3838 (4) at least two benchmark locations in the area in
3939 which the facility will be located; and
4040 (5) if the permit requires a distance, setback, or
4141 buffer from other property or structures as a condition of the
4242 permit, whether the required distance or setback will be met.
4343 SECTION 2. Section 382.05198(c), Health and Safety Code, is
4444 amended to read as follows:
4545 (c) An application for an authorization to use [the issuance
4646 of] a standard permit under this section must include a plot plan
4747 that meets the requirements of Section 382.05195(k).
4848 SECTION 3. Section 382.055(a), Health and Safety Code, is
4949 amended to read as follows:
5050 (a) A preconstruction permit issued or renewed by the
5151 commission is subject to review to determine whether the authority
5252 to operate should be renewed according to the following schedule:
5353 (1) a preconstruction permit issued before December 1,
5454 1991, is subject to review not later than 15 years after the date of
5555 issuance;
5656 (2) a preconstruction permit issued on or after
5757 December 1, 1991, is subject to review:
5858 (A) every six [10] years after the date of
5959 issuance; or
6060 (B) on the filing of an application for an
6161 amendment to the permit, if:
6262 (i) the applicant is subject to Section
6363 382.056;
6464 (ii) the application is filed with the
6565 commission not more than three years before the date the permit is
6666 scheduled to expire; and
6767 (iii) the applicant does not object to
6868 having the permit subjected to review at that time; and
6969 (3) for cause, a preconstruction permit issued on or
7070 after December 1, 1991, for a facility at a nonfederal source may
7171 contain a provision requiring the permit to be renewed at a period
7272 of between five and six [10] years.
7373 SECTION 4. (a) Not later than March 1, 2024, the Texas
7474 Commission on Environmental Quality shall adopt rules necessary to
7575 implement the changes in law made by this Act.
7676 (b) After the effective date of this Act, notwithstanding
7777 the changes in law made by this Act to Sections 382.05195 and
7878 382.055, Health and Safety Code, the Texas Commission on
7979 Environmental Quality may authorize the use of a permit or
8080 authorization to use a permit issued before the effective date of
8181 this Act until the date the permit or authorization would have been
8282 eligible for renewal under the law in effect immediately before the
8383 effective date of this Act, and the former law is continued in
8484 effect for that purpose.
8585 SECTION 5. This Act takes effect September 1, 2023.
