55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to social studies curriculum in public schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 28.002(h-1) and (h-6), Education Code,
1010 are amended to read as follows:
1111 (h-1) In adopting the essential knowledge and skills for the
1212 foundation curriculum under Subsection (a)(1), the State Board of
1313 Education shall, as appropriate, adopt essential knowledge and
1414 skills that develop each student's civic knowledge, including an
1515 understanding of:
1616 (1) the fundamental moral, political, and
1717 intellectual foundations of the American experiment in
1818 self-government;
1919 (2) the history, qualities, traditions, and features
2020 of civic engagement in the United States;
2121 (3) the structure, function, and processes of
2222 government institutions at the federal, state, and local levels;
2323 [and]
2424 (4) the roles and contributions of culturally and
2525 racially diverse groups to the economic, political, and social
2626 development of this state and the United States, including the
2727 histories, contributions, and perspectives of:
2828 (A) women;
2929 (B) Native Americans, Indigenous Americans, and
3030 American Indians;
3131 (C) African Americans;
3232 (D) Latinos;
3333 (E) Asian Americans;
3434 (F) Pacific Islanders;
3535 (G) persons who identify as lesbian, gay,
3636 bisexual, transgender, queer, intersex, or asexual;
3737 (H) persons with disabilities;
3838 (I) members of persecuted religious minorities;
3939 and
4040 (J) members of other ethnic and cultural groups
4141 that have contributed to the history of this state and the United
4242 States; and
4343 (5) the founding documents of the United States,
4444 including:
4545 (A) the entirety of the Declaration of
4646 Independence;
4747 (B) the entirety of the United States
4848 Constitution;
4949 (C) the Federalist Papers, including the
5050 entirety of Essays 10 and 51;
5151 (D) excerpts from Alexis de Tocqueville's
5252 Democracy in America;
5353 (E) the transcript of the first Lincoln-Douglas
5454 debate;
5555 (F) the writings of the founding fathers of the
5656 United States;
5757 (G) the entirety of Frederick Douglass's
5858 speeches "The Meaning of July Fourth for the Negro" and "What the
5959 Black Man Wants"; and
6060 (H) the entirety of Martin Luther King Jr.'s
6161 speech "I Have a Dream."
6262 (h-6) In providing instruction regarding the founding
6363 documents of the United States as described by Subsection (h-1)(5)
6464 [(h-1)(4)], a school district or open-enrollment charter school
6565 shall use those documents as part of the instructional materials
6666 for the instruction.
6767 SECTION 2. This Act applies beginning with the 2023-2024
6868 school year.
6969 SECTION 3. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2023.
