55 AN ACT
66 relating to rules for issuing receipts pertaining to bail bonds.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1704.305, of the Texas Occupations Code
99 is amended as follows:
1010 Sec. 1704.305. BAIL BOND RECEIPT AND INSPECTION; OFFENSE.
1111 (a) A bail bond surety or an agent of a bail bond surety may not
1212 receive money or other consideration or thing of value from a person
1313 for whom the bail bond surety executes a bond unless the bail bond
1414 surety or agent issues a receipt to the person as provided by
1515 Subsection (b).
1616 (b) The receipt must state:
1717 (1) the name of the person who pays the money or
1818 transfers the consideration or thing of value;
1919 (2) the amount of money paid or the estimated amount of
2020 value transferred;
2121 (3) if the person transfers consideration or a thing
2222 of value, a brief description of the consideration or thing of
2323 value;
2424 (4) the name of the defendant [style] and number of the
2525 case and the court in which the bond is executed, if available; and
2626 (5) the name of the person receiving the money,
2727 consideration, or thing of value.
2828 (c) A bail bond surety or an agent of a bail bond surety
2929 shall retain a duplicate or electronic copy of a receipt issued
3030 under Subsection (a). The copy of the receipt shall be made
3131 available for inspection by:
3232 (1) a representative of the board in any county in
3333 which the bail bond surety is licensed; and
3434 (2) an appointed representative of a court in which
3535 the bail bond surety agrees to execute bail bonds.
3636 (d) A receipt may be supplemented.
3737 [(e) A person commits an offense if the person violates this
3838 section. An offense under this section is a Class B misdemeanor.]
3939 SECTION 2. This Act takes effect September 1, 2023.
