| 7 | 7 | | relating to repealing certain provisions relating to dental support |

| 8 | 8 | | organizations. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 254.019(b), Occupations Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) The board shall collect the following information from |
|---|
| 13 | 13 | | dentists licensed by the board in conjunction with the issuance and |
|---|
| 14 | 14 | | renewal of each dental license: |
|---|
| 15 | 15 | | (1) the number and type of dentists employed by the |
|---|
| 16 | 16 | | license holder, if any; |
|---|
| 17 | 17 | | (2) the name under which the license holder provides |
|---|
| 18 | 18 | | dental services and each location at which those services are |
|---|
| 19 | 19 | | provided by that license holder; and |
|---|
| 20 | 20 | | (3) whether the license holder is a participating |
|---|
| 21 | 21 | | provider under the Medicaid program operated under Chapter 32, |
|---|
| 22 | 22 | | Human Resources Code, or the child health plan program operated |
|---|
| 23 | 23 | | under Chapter 62, Health and Safety Code[; |
|---|
| 24 | 24 | | [(4) whether the license holder contracts or enters |
|---|
| 25 | 25 | | into an agreement for business support services with a dental |
|---|
| 26 | 26 | | support organization and, if so, the name and address of the dental |
|---|
| 27 | 27 | | support organization; |
|---|
| 28 | 28 | | [(5) whether the license holder owns all or part of a |
|---|
| 29 | 29 | | dental support organization and, if so, the name and address of the |
|---|
| 30 | 30 | | dental support organization and of each dental office at which the |
|---|
| 31 | 31 | | dental support organization provides services to patients; |
|---|
| 32 | 32 | | [(6) whether the license holder is a party to a dental |
|---|
| 33 | 33 | | support agreement and, if so, the name and address of the dental |
|---|
| 34 | 34 | | support organization that provides services under the agreement; |
|---|
| 35 | 35 | | and |
|---|
| 36 | 36 | | [(7) if the license holder owns all or part of a dental |
|---|
| 37 | 37 | | support organization, whether the license holder's practice is a |
|---|
| 38 | 38 | | party to a dental support agreement and, if so, the name and address |
|---|
| 39 | 39 | | of the dental support organization that provides services under the |
|---|
| 40 | 40 | | agreement]. |

| 41 | 41 | | SECTION 2. The following laws are repealed: |
|---|
| 42 | 42 | | (1) Chapter 73, Business & Commerce Code; and |
|---|
| 43 | 43 | | (2) Sections 254.019(a) and (c), Occupations Code. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2023. |
