| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 12 | 12 | | is amended by adding Section 32.078 to read as follows: |

| 13 | 13 | | Sec. 32.078. COMMUNITY LIVING ASSISTANCE AND SUPPORT |
|---|
| 14 | 14 | | SERVICES (CLASS) WAIVER PROGRAM: PERSONAL ASSISTANCE SERVICES. To |
|---|
| 15 | 15 | | the extent allowed by state and federal law, the commission shall |
|---|
| 16 | 16 | | allow personal assistance services to be provided to a recipient |
|---|
| 17 | 17 | | under the community living assistance and support services (CLASS) |
|---|
| 18 | 18 | | Medicaid waiver program at any time during a 24-hour period. |
|---|
| 19 | 19 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 20 | 20 | | a state agency determines that a waiver or authorization from a |
|---|
| 21 | 21 | | federal agency is necessary for implementation of that provision, |
|---|
| 22 | 22 | | the agency affected by the provision shall request the waiver or |
|---|
| 23 | 23 | | authorization and may delay implementing that provision until the |
|---|
| 24 | 24 | | waiver or authorization is granted. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
