| 7 | 7 | | relating to the language in which certain courses are offered by a |

| 8 | 8 | | public institution of higher education. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 51.917(b), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) The governing board of each institution of higher |
|---|
| 13 | 13 | | education shall establish a program or a short course the purpose of |
|---|
| 14 | 14 | | which is to: |
|---|
| 15 | 15 | | (1) assist faculty members whose primary language is |
|---|
| 16 | 16 | | not English to become proficient in the use of English; and |
|---|
| 17 | 17 | | (2) ensure that courses offered for credit at the |
|---|
| 18 | 18 | | institution are taught in a [the English] language accessible to |
|---|
| 19 | 19 | | all students in the course and that all faculty members are |
|---|
| 20 | 20 | | proficient in the use of the English language, as determined by a |
|---|
| 21 | 21 | | satisfactory grade on the "Test of Spoken English" of the |
|---|
| 22 | 22 | | Educational Testing Service or a similar test approved by the |
|---|
| 23 | 23 | | board. |
|---|
| 24 | 24 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 25 | 25 | | academic year. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
