44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a study regarding the use of perfluoroalkyl and
77 polyfluoroalkyl chemicals in hydraulic fracturing.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. STUDY. The president of the University of
1010 Houston shall designate a department or entity at the university to
1111 conduct, in collaboration with the Railroad Commission of Texas and
1212 the Texas Commission on Environmental Quality, a study on the use of
1313 perfluoroalkyl and polyfluoroalkyl chemicals in the hydraulic
1414 fracturing process, including:
1515 (1) the extent of the use of perfluoroalkyl and
1616 polyfluoroalkyl chemicals in the hydraulic fracturing process in
1717 this state;
1818 (2) whether and to what extent the public may be
1919 exposed through the air or water to perfluoroalkyl and
2020 polyfluoroalkyl chemicals used in the hydraulic fracturing
2121 process;
2222 (3) the effects on human health and the environment of
2323 perfluoroalkyl and polyfluoroalkyl chemicals used in the hydraulic
2424 fracturing process; and
2525 (4) the feasibility of chemical alternatives to
2626 perfluoroalkyl and polyfluoroalkyl chemicals used in the hydraulic
2727 fracturing process; and
2828 (5) whether perfluoroalkyl and polyfluoroalkyl
2929 chemicals should be restricted from use in the hydraulic fracturing
3030 process.
3131 SECTION 2. REPORT. Not later than December 1, 2024, the
3232 department or entity at the University of Houston designated by the
3333 president of the university to conduct the study under Section 1 of
3434 this Act shall prepare a report with the conclusions of the study
3535 and submit the report to the legislature.
3636 SECTION 3. EXPIRATION. This Act expires December 31, 2024.
3737 SECTION 4. EFFECTIVE DATE. This Act takes effect September
3838 1, 2023.
