55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to employment and other assistance for certain unemployed
88 individuals owing payment to certain utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 302, Labor Code, is
1111 amended by adding Section 302.00351 to read as follows:
1212 Sec. 302.00351. EMPLOYMENT ASSISTANCE PROGRAM FOR CERTAIN
1313 UNEMPLOYED INDIVIDUALS OWING PAYMENT FOR UTILITY SERVICES. (a)
1414 The commission shall establish and administer a program under which
1515 the commission provides employment assistance services, including
1616 skills training, job placement, and employment-related services,
1717 to an unemployed individual who:
1818 (1) is receiving unemployment benefits under Subtitle
1919 A; and
2020 (2) has accrued unpaid bills for electric, gas, or
2121 water utility services.
2222 (b) An unemployed individual enrolled in the program is
2323 entitled to receive service under Section 39.101(i), 104.258(d), or
2424 141.004(c), Utilities Code, or Section 13.152, Water Code.
2525 (c) The commission, in consultation with the Public Utility
2626 Commission of Texas, the Railroad Commission of Texas, and
2727 providers of services to which Sections 39.101(i), 104.258(d), and
2828 141.004(c), Utilities Code, and Section 13.152, Water Code, apply
2929 shall adopt rules for the implementation and administration of this
3030 section.
3131 SECTION 2. Section 39.101, Utilities Code, is amended by
3232 adding Subsection (i) to read as follows:
3333 (i) A retail electric provider, power generation company,
3434 aggregator, or other entity that provides retail electric service:
3535 (1) shall provide each residential customer with
3636 information about the employment assistance program described by
3737 Section 302.00351, Labor Code, and, on request by the customer, a
3838 grace period of at least 14 days to allow the customer to enroll in
3939 the program, before disconnecting the customer's service for
4040 nonpayment; and
4141 (2) for a period of 90 days, for a residential customer
4242 enrolled in the program described by Section 302.00351, Labor Code:
4343 (A) may not disconnect service or impose late
4444 fees; and
4545 (B) shall defer collection of the full payment of
4646 bills that are due during that period.
4747 SECTION 3. Section 104.258, Utilities Code, is amended by
4848 adding Subsection (d) to read as follows:
4949 (d) A provider:
5050 (1) shall provide each residential customer with
5151 information about the employment assistance program described by
5252 Section 302.00351, Labor Code, and, on request by the customer, a
5353 grace period of at least 14 days to allow the customer to enroll in
5454 the program, before disconnecting the customer's natural gas
5555 service for nonpayment; and
5656 (2) for a period of 90 days, for a residential customer
5757 enrolled in the program described by Section 302.00351, Labor Code:
5858 (A) may not disconnect natural gas service or
5959 impose late fees; and
6060 (B) shall defer collection of the full payment of
6161 bills that are due during that period.
6262 SECTION 4. Section 141.004, Utilities Code, is amended by
6363 adding Subsection (c) to read as follows:
6464 (c) A distribution system retailer:
6565 (1) shall provide each residential customer with
6666 information about the employment assistance program described by
6767 Section 302.00351, Labor Code, and, on request by the customer, a
6868 grace period of at least 14 days to allow the customer to enroll in
6969 the program, before disconnecting the customer's propane gas
7070 service for nonpayment; and
7171 (2) for a period of 90 days, for a residential customer
7272 enrolled in the program described by Section 302.00351, Labor Code:
7373 (A) may not disconnect propane gas service or
7474 impose late fees; and
7575 (B) shall defer collection of the full payment of
7676 bills that are due during that period.
7777 SECTION 5. Subchapter E, Chapter 13, Water Code, is amended
7878 by adding Section 13.152 to read as follows:
7979 Sec. 13.152. SERVICES PROVIDED TO CUSTOMER ENROLLED IN
8080 EMPLOYMENT ASSISTANCE PROGRAM. A retail public utility that is
8181 required to possess a certificate of public convenience and
8282 necessity or a district or affected county that furnishes retail
8383 water or sewer utility service:
8484 (1) shall provide each residential customer with
8585 information about the employment assistance program described by
8686 Section 302.00351, Labor Code, and, on request by the customer, a
8787 grace period of at least 14 days to allow the customer to enroll in
8888 the program, before disconnecting the customer's service for
8989 nonpayment; and
9090 (2) for a period of 90 days, for a residential customer
9191 enrolled in the program described by Section 302.00351, Labor Code:
9292 (A) may not disconnect service or impose late
9393 fees; and
9494 (B) shall defer collection of the full payment of
9595 bills that are due during that period.
9696 SECTION 6. As soon as practicable after the effective date
9797 of this Act, the Texas Workforce Commission shall adopt the rules
9898 required by Section 302.00351(c), Labor Code, as added by this Act.
9999 SECTION 7. This Act takes effect September 1, 2023.
