| 8 | 8 | | Morbidity Review Committee. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 34.002(b), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) The review committee is a multidisciplinary advisory |
|---|
| 13 | 13 | | committee within the department and is composed of the following 18 |
|---|
| 14 | 14 | | [17] members: |
|---|
| 15 | 15 | | (1) 16 [15] members appointed by the commissioner as |
|---|
| 16 | 16 | | follows: |
|---|
| 17 | 17 | | (A) four physicians specializing in obstetrics, |
|---|
| 18 | 18 | | at least one of whom is a maternal fetal medicine specialist; |
|---|
| 19 | 19 | | (B) one certified nurse-midwife; |
|---|
| 20 | 20 | | (C) one registered nurse; |
|---|
| 21 | 21 | | (D) one nurse specializing in labor and delivery; |
|---|
| 22 | 22 | | (E) one physician specializing in family |
|---|
| 23 | 23 | | practice; |
|---|
| 24 | 24 | | (F) one physician specializing in psychiatry; |
|---|
| 25 | 25 | | (G) one physician specializing in pathology; |
|---|
| 26 | 26 | | (H) one epidemiologist, biostatistician, or |
|---|
| 27 | 27 | | researcher of pregnancy-related deaths; |
|---|
| 28 | 28 | | (I) one social worker or social service provider; |
|---|
| 29 | 29 | | (J) two [one] community advocates [advocate] in |
|---|
| 30 | 30 | | [a] relevant fields [field]; |
|---|
| 31 | 31 | | (K) one medical examiner or coroner responsible |
|---|
| 32 | 32 | | for recording deaths; and |
|---|
| 33 | 33 | | (L) one physician specializing in critical care; |
|---|
| 34 | 34 | | (2) a representative of the department's family and |
|---|
| 35 | 35 | | community health programs; and |
|---|
| 36 | 36 | | (3) the state epidemiologist for the department or the |
|---|
| 37 | 37 | | epidemiologist's designee. |

| 38 | 38 | | SECTION 2. Section 34.003(a), Health and Safety Code, is |
|---|
| 39 | 39 | | amended to read as follows: |
|---|
| 40 | 40 | | (a) Review committee members appointed by the commissioner |
|---|
| 41 | 41 | | serve staggered six-year terms, with one-third or as near as |
|---|
| 42 | 42 | | possible to one-third of the members' terms [of four or five |
|---|
| 43 | 43 | | members, as appropriate,] expiring February 1 of each odd-numbered |
|---|
| 44 | 44 | | year. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2023. |
