2121 AN ACT
2222 relating to a study by the Texas A&M Forest Service of the potential
2323 effects of wildfires in this state.
2424 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2525 SECTION 1. DEFINITIONS. In this Act:
2626 (1) "Fuel loading" means the amount of combustible
2727 material in a defined space expressed quantitatively in terms of
2828 weight of fuel per unit area.
2929 (2) "Service" means the Texas A&M Forest Service.
3030 SECTION 2. STUDY. (a) The service shall conduct a study to
3131 determine the status and condition of fuel loading in wildfire risk
3232 zones in this state and the corresponding risk of wildfire to the
3333 residents, homes, businesses, and ecology of this state.
3434 (b) In conducting the study, the service shall:
3535 (1) establish wildfire risk zones based on fuel
3636 loading and the risk of wildfire to the residents, homes,
3737 businesses, and ecology of this state within geographic areas
3838 defined by the service; and
3939 (2) solicit and consider information from:
4040 (A) the Department of Public Safety;
4141 (B) the Department of Agriculture, including the
4242 Prescribed Burning Board;
4343 (C) the Texas Division of Emergency Management;
4444 (D) the Parks and Wildlife Department;
4545 (E) the Texas Commission on Environmental
4646 Quality;
4747 (F) the State Soil and Water Conservation Board;
4848 (G) the comptroller of public accounts; and
4949 (H) other natural resource representatives as
5050 necessary.
5151 (c) The study must:
5252 (1) for each wildfire risk zone established under
5353 Subsection (b)(1) of this section, consider:
5454 (A) the risk that fuel loading poses;
5555 (B) the projected loss of life, property, and
5656 natural resources should a wildfire occur in the zone;
5757 (C) the financial impact of costs associated
5858 with:
5959 (i) reconstruction in the zone after a
6060 wildfire;
6161 (ii) potential loss of production in the
6262 natural resource and agricultural industries in the zone after a
6363 wildfire; and
6464 (iii) fuel loading mitigation and asset
6565 hardening in the zone; and
6666 (D) whether the money invested in fuel loading
6767 mitigation in the zone exceeds or is less than the value of property
6868 protected by the investment and the amount of the excess or
6969 shortage;
7070 (2) assess the overall economic benefits to this state
7171 of:
7272 (A) prescribed burning;
7373 (B) fuel loading control for wildfire
7474 prevention; and
7575 (C) public investment in fuel loading reduction
7676 projects; and
7777 (3) recommend changes to existing law to ensure that
7878 public and private natural resource managers have the authority and
7979 ability to appropriately mitigate fuel loading risks in each
8080 established risk zone.
8181 SECTION 3. REPORT. Not later than December 1, 2024, the
8282 service shall submit to the governor, the lieutenant governor, the
8383 speaker of the house of representatives, and each standing
8484 committee of the legislature with primary jurisdiction over the
8585 service or another state agency from which information is solicited
8686 under this Act a written report that includes a summary of the study
8787 and any legislative recommendations based on the study.
8888 SECTION 4. EXPIRATION. This Act expires May 1, 2025.
8989 SECTION 5. EFFECTIVE DATE. This Act takes effect
9090 immediately if it receives a vote of two-thirds of all the members
9191 elected to each house, as provided by Section 39, Article III, Texas
9292 Constitution. If this Act does not receive the vote necessary for
9393 immediate effect, this Act takes effect September 1, 2023.
