| 7 | 7 | | relating to the requirements for an electronic system to monitor |
|---|
| 8 | 8 | | tuition and fee exemptions for veterans and military personnel and |
|---|
| 9 | 9 | | their dependents. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 434.00791(b), Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (b) The commission shall ensure a system to electronically |
|---|
| 14 | 14 | | monitor the use of tuition and fee exemptions at institutions of |
|---|
| 15 | 15 | | higher education under Section 54.341, Education Code, is |
|---|
| 16 | 16 | | developed. The system must allow the commission to electronically |
|---|
| 17 | 17 | | receive, for each semester, the following information from |
|---|
| 18 | 18 | | institutions of higher education: |
|---|
| 19 | 19 | | (1) the name of the institution; |
|---|
| 20 | 20 | | (2) the name, identification number, and date of birth |
|---|
| 21 | 21 | | of each individual attending the institution and receiving benefits |
|---|
| 22 | 22 | | for the semester under Section 54.341, Education Code; |
|---|
| 23 | 23 | | (3) for each individual receiving benefits, the number |
|---|
| 24 | 24 | | of credit hours for which the individual received an exemption for |
|---|
| 25 | 25 | | the semester; |
|---|
| 26 | 26 | | (4) for each individual receiving benefits at the |
|---|
| 27 | 27 | | institution during the semester, the total cumulative number of |
|---|
| 28 | 28 | | credit hours for which the individual has received an exemption at |
|---|
| 29 | 29 | | the institution; [and] |
|---|
| 30 | 30 | | (5) copies of any documentation required from an |
|---|
| 31 | 31 | | individual attending the institution for the receipt of benefits |
|---|
| 32 | 32 | | for the semester; and |
|---|
| 33 | 33 | | (6) any other information required by the commission. |
|---|
| 34 | 34 | | SECTION 2. The changes in law made by this Act apply |
|---|
| 35 | 35 | | beginning with the 2023 fall semester. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 40 | 40 | | Act takes effect September 1, 2023. |
