7 | 7 | | relating to the alternative electronic visit verification system |

8 | 8 | | recognized under Medicaid. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 531.024172, Government Code, is amended |
---|
11 | 11 | | by amending Subsections (g), (g-1), and (g-2) to read as follows: |
---|
12 | 12 | | (g) The commission may recognize an alternative [a health |
---|
13 | 13 | | care provider's proprietary] electronic visit verification system, |
---|
14 | 14 | | including a system [whether] purchased or developed by a health |
---|
15 | 15 | | care [the] provider, as complying with this section and allow a |
---|
16 | 16 | | [the] health care provider to use an alternative electronic visit |
---|
17 | 17 | | verification [that] system for a period determined by the |
---|
18 | 18 | | commission if the commission determines that the system: |
---|
19 | 19 | | (1) complies with all necessary data submission, |
---|
20 | 20 | | exchange, and reporting requirements established under this |
---|
21 | 21 | | section; and |
---|
22 | 22 | | (2) meets all other standards and requirements |
---|
23 | 23 | | established under this section. |
---|
24 | 24 | | (g-1) If feasible, the executive commissioner shall ensure |
---|
25 | 25 | | a health care provider that uses an alternative [the provider's |
---|
26 | 26 | | proprietary] electronic visit verification system recognized under |
---|
27 | 27 | | Subsection (g) is reimbursed for the use of that system. |
---|
28 | 28 | | (g-2) For purposes of facilitating the use of an alternative |
---|
29 | 29 | | [proprietary] electronic visit verification system [systems] by |
---|
30 | 30 | | health care providers under Subsection (g) and in consultation with |
---|
31 | 31 | | industry stakeholders and the work group established under |
---|
32 | 32 | | Subsection (h), the commission or the executive commissioner, as |
---|
33 | 33 | | appropriate, shall: |
---|
34 | 34 | | (1) develop an open model system that mitigates the |
---|
35 | 35 | | administrative burdens identified by providers required to use |
---|
36 | 36 | | electronic visit verification; |
---|
37 | 37 | | (2) allow providers to use emerging technologies, |
---|
38 | 38 | | including Internet-based, mobile telephone-based, and global |
---|
39 | 39 | | positioning-based technologies, in the alternative [providers' |
---|
40 | 40 | | proprietary] electronic visit verification system recognized under |
---|
41 | 41 | | Subsection (g) [systems]; and |
---|
42 | 42 | | (3) adopt rules governing: |
---|
43 | 43 | | (A) data submission; [and] |
---|
44 | 44 | | (B) provider reimbursement; and |
---|
45 | 45 | | (C) alternative electronic visit verification |
---|
46 | 46 | | system approval. |
---|
47 | 47 | | SECTION 2. If before implementing any provision of this Act |
---|
48 | 48 | | a state agency determines that a waiver or authorization from a |
---|
49 | 49 | | federal agency is necessary for implementation of that provision, |
---|
50 | 50 | | the agency affected by the provision shall request the waiver or |
---|
51 | 51 | | authorization and may delay implementing that provision until the |
---|
52 | 52 | | waiver or authorization is granted. |
---|
53 | 53 | | SECTION 3. This Act takes effect September 1, 2023. |
