55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of the vulnerable adult protection
88 task force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) In this section:
1111 (1) "Task force" means the vulnerable adult protection
1212 task force established by this Act.
1313 (2) "Vulnerable adult" means:
1414 (A) an elderly person as that term is defined by
1515 Section 48.002, Human Resources Code; or
1616 (B) a person with a disability as that term is
1717 defined by Section 48.002, Human Resources Code.
1818 (b) The vulnerable adult protection task force is
1919 established to study abuse of vulnerable adults in this state.
2020 (c) The task force is composed of:
2121 (1) the commissioner of the Department of Family and
2222 Protective Services or the commissioner's designee;
2323 (2) the banking commissioner of the Texas Department
2424 of Banking or the banking commissioner's designee;
2525 (3) a district attorney selected by the Texas District
2626 and County Attorneys Association;
2727 (4) the following members appointed by the governor
2828 from a list of names submitted by the speaker of the house of
2929 representatives:
3030 (A) a representative from the banking or credit
3131 union industry;
3232 (B) a representative from an unaffiliated
3333 nonprofit organization that advocates for elderly persons
3434 statewide; and
3535 (C) a representative from the health care
3636 industry;
3737 (5) two members of the house of representatives
3838 selected by the speaker of the house of representatives; and
3939 (6) two members of the senate selected by the
4040 lieutenant governor.
4141 (d) A task force member is not entitled to compensation for
4242 service on the task force or reimbursement for expenses incurred in
4343 performing task force duties.
4444 (e) The task force shall:
4545 (1) assess the status of vulnerable adults in this
4646 state;
4747 (2) examine existing services and resources
4848 addressing the needs of vulnerable adults in this state and any
4949 barriers impeding those services and resources;
5050 (3) determine the economic and human impact of
5151 financial exploitation of vulnerable adults in this state;
5252 (4) review possible solutions that could reduce the
5353 incidents of financial exploitation of vulnerable adults in this
5454 state; and
5555 (5) develop recommendations to address abuse of
5656 vulnerable adults in this state, including:
5757 (A) possible legislation; and
5858 (B) other state policies or responses.
5959 (f) A state agency shall cooperate with and assist the task
6060 force in carrying out the duties of the task force.
6161 (g) Not later than December 31, 2024, the task force shall:
6262 (1) prepare a written report that summarizes the task
6363 force's findings under this section and recommends solutions for
6464 improving the well-being of vulnerable adults in this state; and
6565 (2) submit the written report to the:
6666 (A) governor;
6767 (B) lieutenant governor;
6868 (C) speaker of the house of representatives;
6969 (D) chair of the House Human Services Committee;
7070 and
7171 (E) chair of the Senate Health and Human Services
7272 Committee.
7373 (h) The task force is abolished and this Act expires June 1,
7474 2025.
7575 SECTION 2. This Act takes effect September 1, 2023.
