9 | 9 | | educators certified by other states. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 21, Education Code, is |
---|
12 | 12 | | amended by adding Section 21.0521 to read as follows: |
---|
13 | 13 | | Sec. 21.0521. TEMPORARY CERTIFICATION OF EDUCATORS FROM |
---|
14 | 14 | | OUTSIDE THIS STATE. (a) The board shall: |
---|
15 | 15 | | (1) establish a temporary educator certificate for |
---|
16 | 16 | | educators certified by other states; and |
---|
17 | 17 | | (2) immediately issue a certificate described by |
---|
18 | 18 | | Subdivision (1) to a person who applies for a certificate issued |
---|
19 | 19 | | under Section 21.052. |
---|
20 | 20 | | (b) The board may rescind a temporary educator certificate |
---|
21 | 21 | | issued to a person under this section if the board determines as a |
---|
22 | 22 | | result of a review of the person's credentials that the person does |
---|
23 | 23 | | not meet the eligibility requirements under Subsection (c). |
---|
24 | 24 | | (c) To be eligible for a temporary educator certificate |
---|
25 | 25 | | issued under this section, a person must: |
---|
26 | 26 | | (1) hold a valid, unexpired, non-temporary |
---|
27 | 27 | | certificate or similar credential in another state that qualifies |
---|
28 | 28 | | the person to be employed as an educator in that state; and |
---|
29 | 29 | | (2) hold a bachelor's degree from an institution of |
---|
30 | 30 | | higher education that is, and at the time the person received the |
---|
31 | 31 | | degree was, accredited. |
---|
32 | 32 | | (d) Except as provided by Subsection (e), a temporary |
---|
33 | 33 | | educator certificate issued under this section expires on the |
---|
34 | 34 | | earlier of: |
---|
35 | 35 | | (1) the first anniversary of the date the certificate |
---|
36 | 36 | | is issued; or |
---|
37 | 37 | | (2) the date the person is issued a certificate under |
---|
38 | 38 | | Section 21.052. |
---|
39 | 39 | | (e) A temporary educator certificate issued under this |
---|
40 | 40 | | section to an educator who is the spouse of a person serving on |
---|
41 | 41 | | active duty as a member of the armed forces of the United States, as |
---|
42 | 42 | | those terms are defined by Section 55.001, Occupations Code, |
---|
43 | 43 | | expires on the third anniversary of the date the certificate is |
---|
44 | 44 | | issued or a later date specified by board rule. |
---|
45 | 45 | | (f) A temporary educator certificate issued under this |
---|
46 | 46 | | section may not be reissued or renewed. |
---|
47 | 47 | | SECTION 2. Sections 21.052(c), (d), (d-1), (e), and (i)(1) |
---|
48 | 48 | | and (2), Education Code, are repealed. |
---|
49 | 49 | | SECTION 3. As soon as practicable after the effective date |
---|
50 | 50 | | of this Act, the State Board for Educator Certification shall adopt |
---|
51 | 51 | | rules necessary to implement Section 21.0521, Education Code, as |
---|
52 | 52 | | added by this Act. |
---|
53 | 53 | | SECTION 4. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2023. |
