88 AN ACT
99 relating to the authority of the attorney general to represent
1010 county officials in certain cases.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 157.9015, Local Government Code, is
1313 amended by adding Subsection (d) to read as follows:
1414 (d) This subsection applies only to a county with a
1515 population of more than one million. If a district or county
1616 attorney declines to represent a county official or employee in a
1717 suit described by Subsection (c), the county official or employee
1818 may request representation from the attorney general, and the
1919 attorney general may offer to represent the county official or
2020 employee.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2023.
