55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of certain federal regulations to
88 motor vehicles that are manufactured, sold, and operated
99 exclusively in this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 750, Transportation Code, is amended by
1212 adding Section 750.001 to read as follows:
1313 Sec. 750.001. APPLICABILITY OF CERTAIN FEDERAL REGULATIONS
1414 TO MOTOR VEHICLES MANUFACTURED, SOLD, AND OPERATED EXCLUSIVELY IN
1515 TEXAS. (a) This section applies only to a motor vehicle that is
1616 manufactured, sold, and operated exclusively in this state.
1717 (b) For purposes of this section, a motor vehicle is
1818 manufactured exclusively in this state if the vehicle is
1919 manufactured without the inclusion of any parts or materials
2020 imported from another state or country other than generic and
2121 insignificant parts or materials.
2222 (c) A motor vehicle manufactured and sold exclusively in
2323 this state must have the words "Made in Texas" affixed to the motor
2424 vehicle in the manner, form, and location prescribed by the Texas
2525 Department of Motor Vehicles.
2626 (d) A motor vehicle to which this section applies is not
2727 subject to any federal law or regulation under the authority of the
2828 United States Congress to regulate interstate commerce relating to:
2929 (1) motor vehicle emissions or fuel efficiency
3030 standards;
3131 (2) required equipment for a motor vehicle, other than
3232 safety equipment; or
3333 (3) the use or installation of remote vehicle
3434 disabling technology, other than a law or regulation that prohibits
3535 the use or installation of that technology.
3636 (e) For purposes of Subsection (d)(3), "remote vehicle
3737 disabling technology" means any application or device, including
3838 software, firmware, and hardware, that, when activated or engaged,
3939 allows a person to disable the operation of a motor vehicle. The
4040 term does not include an ignition interlock device as defined by
4141 Article 42A.408, Code of Criminal Procedure.
4242 SECTION 2. The change in law made by this Act applies only
4343 to a motor vehicle that is manufactured on or after the effective
4444 date of this Act.
4545 SECTION 3. This Act takes effect September 1, 2023.
