77 relating to prohibiting the operation of supervised drug
88 consumption sites; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 481.002, Health and Safety Code is
1111 amended by adding subsection (56) to read as follows:
1212 (56) "Supervised Drug Consumption Site" means any facility
1313 or premises operated or intended to provide an environment for the
1414 unlawful use of a controlled substance.
1515 SECTION 2. Subchapter D, Chapter 481, Health and Safety
1616 Code is amended by adding Section 481.142 to read as follows:
1717 Sec. 481.142. OFFENSE: OPERATION OF SUPERVISED DRUG
1818 CONSUMPTION SITES. (a) A person commits an offense if the person:
1919 (1) knowingly operates a supervised drug consumption
2020 site as defined by this chapter; or
2121 (2) either as an owner, lessee, agent, employee,
2222 occupant, or mortgagee, knowingly and intentionally opens, leases,
2323 rents, profits from, maintains, or makes available for use, with or
2424 without compensation, any premises for the purpose of operating a
2525 supervised drug consumption site as defined by this chapter.
2626 (b) An offense under Subsection (a) is a felony of the
2727 second degree.
2828 SECTION 3. This Act takes effect September 1, 2023.
