| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 481.002, Health and Safety Code is |
|---|
| 11 | 11 | | amended by adding subsection (56) to read as follows: |
|---|
| 12 | 12 | | (56) "Supervised Drug Consumption Site" means any facility |
|---|
| 13 | 13 | | or premises operated or intended to provide an environment for the |
|---|
| 14 | 14 | | unlawful use of a controlled substance. |
|---|
| 15 | 15 | | SECTION 2. Subchapter D, Chapter 481, Health and Safety |
|---|
| 16 | 16 | | Code is amended by adding Section 481.142 to read as follows: |

| 17 | 17 | | Sec. 481.142. OFFENSE: OPERATION OF SUPERVISED DRUG |
|---|
| 18 | 18 | | CONSUMPTION SITES. (a) A person commits an offense if the person: |
|---|
| 19 | 19 | | (1) knowingly operates a supervised drug consumption |
|---|
| 20 | 20 | | site as defined by this chapter; or |
|---|
| 21 | 21 | | (2) either as an owner, lessee, agent, employee, |
|---|
| 22 | 22 | | occupant, or mortgagee, knowingly and intentionally opens, leases, |
|---|
| 23 | 23 | | rents, profits from, maintains, or makes available for use, with or |
|---|
| 24 | 24 | | without compensation, any premises for the purpose of operating a |
|---|
| 25 | 25 | | supervised drug consumption site as defined by this chapter. |
|---|
| 26 | 26 | | (b) An offense under Subsection (a) is a felony of the |
|---|
| 27 | 27 | | second degree. |
|---|
| 28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
