66 AN ACT
77 relating to the labeling, advertising, and sale of products as
88 "zero emissions".
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 17, Business & Commerce Code, is amended
1111 by adding Subchapter E-1 to read as follows:
1212 SUBCHAPTER E-1. LABELING, ADVERTISING, AND SALE OF "ZERO
1313 EMISSIONS" PRODUCTS
1414 Sec. 17.71. "ZERO EMISSIONS" LABELING STANDARD. (a) In
1515 this section, "greenhouse gas emissions" has the meaning assigned
1616 by Section 382.05102, Health and Safety Code.
1717 (b) A product that is sold in this state may not use "zero
1818 emissions" or equivalent phrasing if:
1919 (1) the product produces greenhouse gas emissions when
2020 used;
2121 (2) greenhouse gas emissions were produced in the
2222 manufacturing of the product; or
2323 (3) greenhouse gas emissions are produced to provide
2424 electricity to charge the product's rechargeable battery.
2525 Sec. 17.72. DECEPTIVE TRADE PRACTICE. A violation of
2626 Section 17.71 is a deceptive trade practice under Subchapter E and
2727 is actionable under that subchapter.
2828 SECTION 2. This Act takes effect September 1, 2023.
