| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 17, Business & Commerce Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter E-1 to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER E-1. LABELING, ADVERTISING, AND SALE OF "ZERO |
|---|
| 13 | 13 | | EMISSIONS" PRODUCTS |
|---|
| 14 | 14 | | Sec. 17.71. "ZERO EMISSIONS" LABELING STANDARD. (a) In |
|---|
| 15 | 15 | | this section, "greenhouse gas emissions" has the meaning assigned |
|---|
| 16 | 16 | | by Section 382.05102, Health and Safety Code. |
|---|
| 17 | 17 | | (b) A product that is sold in this state may not use "zero |
|---|
| 18 | 18 | | emissions" or equivalent phrasing if: |
|---|
| 19 | 19 | | (1) the product produces greenhouse gas emissions when |
|---|
| 20 | 20 | | used; |
|---|
| 21 | 21 | | (2) greenhouse gas emissions were produced in the |
|---|
| 22 | 22 | | manufacturing of the product; or |
|---|
| 23 | 23 | | (3) greenhouse gas emissions are produced to provide |
|---|
| 24 | 24 | | electricity to charge the product's rechargeable battery. |
|---|
| 25 | 25 | | Sec. 17.72. DECEPTIVE TRADE PRACTICE. A violation of |
|---|
| 26 | 26 | | Section 17.71 is a deceptive trade practice under Subchapter E and |
|---|
| 27 | 27 | | is actionable under that subchapter. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2023. |
